다국어 초록 (Multilingual Abstract)

We used a 413 million bill sheet in last year and amount was 5,301 trillion korea Won. A inchoate instrument is the incomplete bill, which is not satisfied the demand set out of Article 1, 75 of Bill and Notes Act. The inchoate instrument completed is available as a bill or note. The authority to fill up is not appeared on the inchoate instrument. So The third party can not recognize it. If such an instrument is completed without authority or otherwise than in accordance with the authority given: A party who signed the instrument before the completion may invoke such lack of authority as a defence against a holder who had knowledge of such lack of authority when he became a holder; A party who signed the instrument after the completion is liable according to the terms of the instrument so completed. A right of action arising on an instrument may no longer be exercised after 3 years have elapsed: Against the acceptor or the maker or the guarantor of an instrument payable at a definite time, from the date of maturity.
The purpose of this study is to establish assistance in solving problems on the exercise of the right where an inchoate instrument are concerned. The Bills Act Article 10 stipulates only things about abusing filling up. The numerous cases must actually depend on the practices and theories. A bill is the bill of which requirements are blank except for the signature. The holder of an inchoate instrument exercise his right concerning the bill until its requirements are filled in accuracy
The valid period of authority to complete on the draft missing maturity day is the three years from the issue date of inchoate instrument. For the reason, the purpose this thesis is to research the right to complete an inchoate instrument and study on the suspension of prescription and request of an inchoate instrument.
