경찰과 자치단체간의 치안업무 협의조정기구에 관한 연구 = A Study on the Coordination Organizations for the Police and the Local Governments in Terms of Public Security

Recently, the police organizations have begun to place more emphasis on maintaining public security through cooperative efforts with local residents, private security firms, public organizations, and local governments than on the conventional crime prevention activities such as patrolling. In particular, the network between the police and the local governments that are in charge of security administration and the community's overall administration respectively plays an important role in maintaining local security; the public security administrative committee of the regional local governments and the community public security committee of the basic local governments take charge of consultation and mediation of the matters regarding the two organizations’ public security policies.
Although the public security administrative committee, newly established in the Article 16 of 1991 Police Law, was comparatively well managed in the beginning, it has became nominal as there is no need for consultation and mediation with the appearance of a chief executive elected by the popular vote in 1995. Also, the community public security administrative committee of Jeju Special Self-governing Province, set up in July 2006 and has been run on a trial basis prior to the introduction of the local police system, is facing various limitations. Furthermore, the community public security committee, organized in February 2008 in affiliation with the police and the local governments as part of an effort to establish law and order by the Lee Myung-bak administration, is far from functioning as a representative organization of local people since it consists of public institutions that have not gone through the experts' sufficient examination.
Now that the introduction of the local police system is mandated by the law, it is consequential to analyze the problems of the public security administrative committee and the community public security committee and provide the upcoming government in 2013 with the possible options for making improvements. Therefore, after conducting a comprehensive literature review and an analysis of the problems faced by the public security administrative committee and the community public security committee, this study suggests unifying the cooperative windows, upgrading the committees to an independent administrative board, bestowing authority on them, improving their representative character, and amendment of the related laws.

국문 초록 (Abstract)

최근 경찰조직은 과거 순찰위주의 범죄예방활동에서 벗어나 지역주민, 민간경비업체, 공공관서, 지방자치단체 등과의 연계를 통한 협력치안으로 경찰활동의 초점을 옮겨가고 있다. 특히 치안행정을 담당하는 경찰과 지역사회의 종합행정을 담당하는 지방자치단체와의 네트워크 구성은 지역치안을 지속화시키는데 중요한 역할을 담당한다. 양 기관의 치안문제를 협의・조정하는 기구는 광역지방자치단체의 치안행정협의회와 기초지방자치단체의 지역치안협의회가 있다.
1991년 제정된 경찰법에 의해 신설된 치안행정협의회는 초기에는 어느 정도 운영이 되었으나 1995년 민선자치단체장이 등장하면서 협의와 조정의 필요성이 사라져 지금은 유명무실하게 운영되고 있다. 그리고 2006년 출범한 제주특별자치도 치안행정위원회도 자치경찰제 도입에 앞서 시범적으로 운영하고 있으나 여러 가지 한계에 부딪치고 있다. 또한, 이명박 정부에서 법질서 확립운동의 일환으로 경찰과 지방자치단체를 중심으로 2008년부터 출범한 지역치안협의회는 전문가의 충분한 검토 없이 관변단체 위주로 구성되어 지역주민의 대표기구라고 하기에는 거리가 멀다.
법률에 의해 지방자치경찰제도 도입이 의무화된 현시점에서 자치경찰 도입에 앞서 치안업무 협의조정기구의 문제점을 짚어보고 2013년 새로 들어설 신정부에 이에 대한 개선방향을 제시하는 것은 의미가 크다고 할 수 있다. 그러므로 이 연구에서는 문헌고찰방법을 통해 치안행정협의회와 지역치안협의회의 문제점을 분석하고 이에 대한 개선방안으로서 협력창구의 단일화, 독립된 행정위원회로의 격상, 실질적 권한부여, 주민대표성 향상, 관련 법률의 정비를 제시하였다.
