바이오헬스 산업 발전을 위한 의료정보 활용의 법제적 쟁점 = A study on the legal issues of utilization of medical information for development of bio-health industry

As the use of data has become increasingly important in all industrial sectors in the recent years, the bio field sector is not an exception. Vast amount of bio big data is being produced, e.g., genome information which began with the human genome project, medical information due to electronic medical records becoming the norm, lifestyle habits information due to wide spread digital healthcare devices, etc. These data are used, for example, in patient-specific precision medical care, diagnoses and treatments using medical AI’s, and development of new drugs, and in the biomedical fields, this trend is expected to be accelerated in the future. However, as the biotechnology field is directly linked to the health of the public and as bio big data contains sensitive medical information, there are restrictions on industrial development due to various regulations.
Accordingly in this paper, we reviewed the legal issues of utilization of medical information which should be examined for development of the bio-health industry. First, we examined the importance of bio big data according to changes in industrial environments was examined with the major cases of utilization (of medical information) and related policies of major countries, and for the issue of legal protection and utilization of medical information. we examined from the aspects of database protection and personal information protection. In this regard, as the recently implemented major legislations abroad related to personal information protection, we examined the recently implemented “General Data Protection Regulation (GDPR)” of the European Union and “Next Generation Medical Infrastructure Act” of Japan, which was recently implemented to revitalize research and development in the medical fields. Further, we examined utilization of medical information by using block chain technology, which has been attracting attention in various industrial fields recently. Also as the criteria for legal reviews, we examined the validity or recognition of medical information transaction through private contracts, effects of smart contracts, and the issue of the legal concept of ownership of medical information, the issue of preservation and disposal of medical information, and the issue of ICO deregulation.

국문 초록 (Abstract)

최근 모든 산업 분야에 걸쳐 데이터 활용의 중요성이 높아지고 있는 가운데, 바이오 분야도 예외는 아니다. 인간 게놈 프로젝트를 시작으로 한 유전체 정보, 전자의무기록의 일반화로 인한 의료정보, 디지털 헬스케어 기기의 보급 등에 따른 생활습관 정보 등 방대한 양의 바이오 빅데이터가 생산되고 있다. 이러한 데이터는 환자 맞춤형 정밀의료, 의료용 AI를 이용한 진단 및 치료, 신약개발 등에 활용되고 있으며, 바이오 의료 분야에서 이러한 추세는 향후 더욱 가속화될 전망이다. 그러나 바이오 분야는 국민의 건강에 직결되어 있고, 바이오 빅데이터에는 민감한 의료정보가 포함되어 있어 여러 가지 규제로 인하여 산업발전에 제약이 되고 있다.
이에 본 고에서는 바이오 헬스 산업 발전을 위해서 살펴보아야 할 의료정보 활용의 법제적 쟁점을 검토해 보았다. 먼저 산업 환경 변화에 따른 바이오 빅데이터의 중요성을 주요 활용 사례 및 주요국의 관련 정책과 함께 살펴보고, 의료정보의 법적 보호 및 활용의 문제를 데이터베이스 보호의 측면, 개인정보 보호의 측면에서 살펴 보았다. 이와 관련하여 최근 시행된 해외 주요법제로 개인정보 보호와 관련하여 유럽연합의 ‘일반 개인정보보호법(GDPR)’과 의료분야의 연구개발 활성화를 위하여 제정된 일본의 ‘차세대의료기반법’을 살펴 보았다. 나아가 최근 다양한 산업분야에서 주목을 받고 있는 블록체인 기술을 이용하여 의료정보를 활용하는 방안에 대하여 검토해 보고, 이에 따른 법적 검토사항으로 사적계약을 통한 의료정보의 거래 인정여부, 스마트 계약의 효력, 의료정보의 소유권의 법적 개념의 문제, 의료정보의 보존 및 폐기의 문제 및 ICO 규제 완화의 문제 등에 대하여 살펴 보았다.
