보상위탁제도의 문제점과 개선방안 = Problems and Improvement Measures ofthe Compensation Entrustment System

국문 초록 (Abstract)

공익사업에 있어 보상업무의 전문성, 직원의 업무 과다 또는 기피 등으로 인해 사업시행자가 보상업무를 외부에 위탁하는 경우가 늘고 있다.｢토지보상법｣은 보상업무를 보상전문기관에 위탁하도록 규정하고 있으나 실제에 있어서는 보상전문기관이 아닌 민간회사에 위탁하는 경우가 많은 것으로 나타났다. 또한, 위탁수수료 규정이 불합리하거나 미비하여 보상위탁제도가 활성화되지 못하는 실정이다. 본 연구는 보상위탁제도의 문제점을 분석하고 합리적인 개선방안을 도출하는 것이 목적이다. 연구 결과 보상위탁제도의 문제점을 입법상의 문제점, 보상수탁기관의 문제점, 위탁수수료의 문제점으로 구분하여 도출한 후 각 문제점에 대응하여 현실적인 개선방안을 제안하였다. 연구결과는 보상위탁제도의 활성화에 기여하고 나아가 원활한 공익사업 추진에 기여할 것으로 기대된다.

다국어 초록 (Multilingual Abstract)

In public works projects, project operators are increasingly outsourcing compensation tasks due to the need for specialized expertise, excessive workloads, or personnel’s reluctance to undertake such tasks. Although the Land Compensation Act stipulates that compensation tasks should be entrusted to specialized compensation institutions, in practice, such tasks are often entrusted to private companies rather than specialized compensation institutions. Furthermore, the compensation entrustment system has not been sufficiently utilized because the regulations concerning entrustment fees are unreasonable or inadequate.
The purpose of this study is to analyze the problems of the compensation entrustment system and derive reasonable improvement measures. The results of the study identified the problems of the compensation entrustment system in three categories: legislative problems, problems of compensation trustees, and problems related to entrustment fees. In response to each of these problems, realistic improvement measures were proposed.
The findings of this study are expected to contribute to the promotion of the compensation entrustment system and, furthermore, to the smooth implementation of public works projects.
