자치경찰제의 도입과 경찰의 수사권독립 = Introduction of Self - governing Police System and Independence of its Rights of Criminal Investigation

The proper independent criminal investigation rights in the police is to maintain the use of the independent criminal investigation rights for certain regular cases and to revamp the present system of criminal investigation exclusively owned by the procecutors office. The necessity of independent criminal investigation rights has been frequently discussed to provide better police enforcement service for the people and to increase the morale of the police under the present system. This delicate topic has been attracted to the attention of the general public on the various basis. The thesis surveys the theoretical issues which have proclaimed the urgent necessity of independent criminal investigation as an extension of the self-governing entity, analyzes the internal conditions in the police and present situations for the possibility of desirable autonomous investigation, and reviews the proper future directions of the independent criminal investigation issues. As a harmonious alternative to introduce the self-governing police system as well as to allow the independence of criminal investigation, it is suggested that the police could employ the first right of criminal investigation and the prosecutors office could use the second and supplementary right of investigation.
