사업자와 소비자간 전자상거래에서 소비자 보호에 관한 연구 : 전자상거래등에서의 소비자보호에 관한 법률'을 중심으로 = A Study on Consumer Protection in B to C Electronic Commerc : centering around "the Act on the Consumer Protection in the Electronic Commerce Transactions, etc"

국문 초록 (Abstract)

과학기술의 발전으로 인하여 등장한 전자상거래는 기존의 거래 형태와 동일하게 다양한 문제점을 내포하고 있으며, 이 중 가장 중요한 문제점 중의 하나는 이를 이용하는 소비자피해문제이다. 따라서 전자상거래를 이용하는 소비자를 효율적으로 보호하며, 건전한 거래분야로 발전할 수 있도록 관련법령을 제·개정하고 있으며, 제도를 보완하고 있다. 이러한 법령 중에서 가장 대표적인 것은 2002년에 제정된 '전자상거래 등에서의 소비자보호에 관한 법률'이다. 본 논문에서는 동법의 내용을 전자상거래의 체결이전, 체결 및 이행의 과정으로 구분하여 사업자와 소비자간의 권리와 의무를 고찰함과 더불어 동법의 문제점을 지적하고 이에 대한 개선방안을 제시하였다. 구체적으로 살펴보면, 동법의 적용배제조항, 청약 철회권의 행사요건과 효과 및 전자상거래중개업자의 책임 등의 분양에서 문제점이 존재하며, 이에 대한 개선방안을 해당분야에서 구체적으로 제시하여 보다 효율적으로 소비자를 보호할 수 있는 방안을 제시 하였다.

Electronic Commerce(EC) that coms from the development of scientific technique has various legal problems like other transactions. One of the important problems is the consumer damage. So, many Acts to protect consumers are enacted recently. One of these Acts is "The Act on the Consumer Protection in the Electronic Commerce Transactions, etc" enacted in 2002. In this paper, Istudied rights of consu,er and abligations of business in legal relation of Electronic Commerce. And then, I indicated problems and proposed plans of reformation of the Act. To put it concretely, The Act has problems in spheres of exclusion of application supplements on these problems and plans to protect consumers efficiently.
