The corona virus has changed our daily lives. In particular, the discussions have been very active on the scope of allowing information processor or controller to use, collect, and provide data, as this topic relates to data sovereignty, including self determination of sensitive information, and information rights. In the post-corona era, the importance of 'data sovereignty' will be more important than before.
The discussion is still ongoing as the National Assembly passed revised versions (as of January 9th, 2019) of three data bills - the Personal Information Protection Act, Information and Communications Network Act and Protection of Credit Information Act - which relaxing regulations on the use of personal data including credit ratings.
However, there have been on-going criticisms from civil organizations about revised versions of 'three data bills' as people feel anxious about breach of confidentiality of their identification data.
Therefore, in order to prepare for the post-corona era and to minimize the infringement of personal information from 'three data act', a concept of 'data sovereignty' must be defined accurately. This paper seeks to define the idea of 'data sovereignty' by finding legal grounds for it and analyzes by using comparative law perspectives.
The paper argues that individual data sovereignty is a core value in the era of the 4th Industrial Revolution, and the data sovereignty should be guaranteed by constitution, the constitutional reform is necessary.
