학교폭력 피해학생의 보호에 관한 법제도적 고찰 = A study on the Legal Protection of Victims of Violence at School

다국어 초록 (Multilingual Abstract)

School violence have become a serious problem since 1995 in Korea. Whenever serious accidents caused by school violence occurred, government department have planned various remedies including special law regulating school violence. Past policies for school violences have been focused on offender students such as strict punishments and guidance program. But those policies can not accomplish prevention of violence. So, it is necessary to convert from offender based policy to victim based policy. By survey, most victims of school violence experience serious psychological problem such as anger, depression and impulse to suicide. So, the policy for school violences should be focused on protection of victims with schol violence prevention. In this study, three strategies are proposed to protect effectively victims of school violence. First, victims survey should be improved to analyze correctly the victims`s aftereffects of violence and be done regularly. Second, the section of special law regarding protection of victims of school violence should be revised as follows; Victim students can claim positively the protection management guaranteed in special law as their rights and should be noticed those protection methods in advance. Third, victim`s main interests after school violence are not to be the victims of violence again and adjust into school life including focusing on study. It is necessary to improve relationship between victim students and offender students to fulfill victims goals. Therefore, restorative justice program should be introduced to improve relationship between victims and offenders.
