Whether the occurrence of property loss on the part of the victim is required for the establishment of criminal fraud has long been a controversial issue in Korean criminal law. Article 347 of the Korean Criminal Act merely provides that a person who, by deceiving another, receives property or obtains a pecuniary benefit shall be punished. Unlike § 263 of the German Criminal Code, it does not expressly require the occurrence of property loss. Accordingly, Korean scholarship has been divided among the requirement theory, the non-requirement theory, and the dualist theory. The Korean Supreme Court, for its part, has traditionally taken the position that criminal fraud may be established once property is transferred by deception, even if no actual property loss has occurred.
However, if the non-requirement theory is applied without limitation, the scope of criminal fraud may become excessively broad. If criminal fraud is recognized merely on the basis of a but-for causal relationship-that the victim would not have disposed of the property but for the deception-even collateral misrepresentations unrelated to the essence of the transaction, violations of administrative regulations, or breaches of moral trust could be absorbed into the category of criminal fraud. The central issue, therefore, is not whether to add property loss as an unwritten element of the offense, but how to reasonably limit the outer scope of criminal fraud while respecting the wording of Article 347 of the Korean Criminal Act.
From this perspective, this article compares and examines the U.S. Supreme Court’s decision in Kousisis v. United States (2025) and the Korean Supreme Court’s decision in the Cultural Heritage Repair case. In Kousisis, the Court held that federal wire fraud does not require the victim to suffer a net pecuniary loss. At the same time, however, it limited the scope of federal fraud by relying on the requirement that the object of the scheme be the acquisition of money or property and that the false statement be material. By contrast, in the Cultural Heritage Repair case, the Korean Supreme Court held that the mere fact that the defendants violated registration requirements under the Cultural Heritage Repair Act or other administrative regulations did not automatically establish deception for purposes of criminal fraud. Rather, the decisive question was whether the violation concerned an essential aspect of the contract, to the extent that completion of the work would have been impossible even if the contract had been performed according to its terms.
Although these two decisions appear at first glance to reach different conclusions, they share a common underlying structure. Both refuse to treat actual net economic loss as an indispensable requirement for criminal fraud. At the same time, both resist recognizing fraud on the basis of mere regulatory violations or collateral misrepresentations. The difference lies in how each court evaluates whether the false statement in the particular case concerned the essence of the transaction or an important contractual matter.
Therefore, under Korean criminal law, the scope of criminal fraud should be controlled not by adding property loss as an independent unwritten element, but by limiting actionable deception to false statements concerning an important part or essential content of the transaction. The central question in determining criminal fraud is not whether the victim suffered actual economic loss, but whether the deception impaired the essential basis of the victim’s decision to dispose of property. This interpretation respects the text of Article 347 while providing a reasonable standard for preventing criminal fraud from expanding into a general offense of dishonesty.
