장애인차별금지법 제정을 위한 사회적 토대 : 미국장애인법(ADA)과 관련하여 = Social Contexts for Enacting the Disability Discrimination Act Related to the Americans with Disabilities Act(ADA)

국문 초록 (Abstract)

본 연구는 한국사회에서 장애인차별금지법의 필요성과 그 제정을 위한 사회적 토대의 구성에 대한 것이다. 한국사회는 장애인복지법을 비롯한 장애 관련 법률들을 마련하여 장애인의 기본적인 권리를 보장하고자 하였으나, 이러한 현행 장애 관련 법률들은 장애의 의료적 모델에 따른 복지시책에 불과하다는 비판이 제기된다. 따라서 강력하고 실효성 있는 장애인차별금지법의 제정이 요구되는 것이다.
장애인차별금지법의 제정을 위한 사회적 토대를 구성하고자 장애의 사회적 모델이 반영되어 있는 미국 장애인법을 비교분석하였다. 미국사회가 장애의 사회적 모델에 입각한 미국장애인법을 마련할 수 있었던 입법과정을 검토하여, 한국사회에서 장애인차별금지법을 제정하기 위해 요구되는 사회적 토대가 무엇인가를 규명하려는 시도였던 것이다.
한국사회에서 장애인차별금지법을 제정하기 위해서는 다음과 같은 사회적 토대가 요구된다. 첫째, 장애인차별금지법 제정에 대한 사회 전반적 합의를 이뤄내기 위해 장애인 수당과 같은 사회적 비용을 실질적인 수준으로 증가 및 확대하여야 한다. 둘째, 강력하고 끊임없는 장애인단체의 사회운동을 통하여 장애에 대한 사회적 인식을 변화시켜나가야 한다. 셋째, 장애에 대한 사회적 인식 변화를 위해 복지담론이 아닌, 경제적 담론으로 장애 관련 논의들에 접근하여야 한다.

다국어 초록 (Multilingual Abstract)

Recently in South Korea, there is an active movement for the establishment of the act for prohibition of discrimination against the disabled. In order to establish the act, the organizations dealing with the problems of the disabled have formed the supporting association for the establishment of the act for prohibition of discrimination against the disabled, and persistently held the public hearing.
The Americans with Disabilities Act(ADA) in the U.S. could be regarded as the exemplary case for this act, without any related research work in South Korea. This dissertation has analyzed and inquired into ADA, whlch is based on the social model of disability. It also examined the background, the process of establishment, and the actual results of execution after establishment. By so doing, it looks over the influence or meaning of the same act in South Korea.
In order to enact the act for prohibition of discrimination against the disabled in South Korea, three social contexts are required. Firstly, social expenses such as disability benefits have to be increased. Secondly, disability movement should be strengthened. Thirdly, disability-related discussions have to be made by the economic discourse instead of the welfare discourse to change the social recognition about disability.
