역사적 제도주의 관점에서의 국가보안법 경로변화 연구 = A Study on the Policy Path Change in the National Security Law according to the Historical Institutionalism

다국어 초록 (Multilingual Abstract)

The purpose of this study is to determine the continuity of maintenance and change factors by analyzing transition process in the National Security Law of South Korea since 1948 within the framework of Path Dependence and Path Evolution.
The analysis presents that the National Security Law of South Korea was started with critical moment and contingency which the Model of Path Dependence suggests and has continued for a long time despite of a number of external shocks. Also, institutional conversion is less likely to appear with strong Policy Advocacy Coalition supported by the conservative force formed in the military tension between North and South Korea. Consequentially, it is a typical case of the Model of Path Dependence represented by the Punctuated Equilibrium Model as the Function of the National Security Law has had a long-term maintenance in spite of external and internal change factors. Moreover, it is also a Layering Type of the Path Evolution Model in that its identity has been continually maintained apart from partial changes.
It stems from outstanding environmental adaptability based on the support of Policy Advocacy Coalition and policy understanding with ruling power centered on the conservative force. In order for the established the National Security Law, it is required to reduce discretionary power in Path Operators so as to actively response to environment changes. Furthermore, building up public trust by a bond of sympathy is needed rather than policy understanding with the ruling power.

국문 초록 (Abstract)

본 연구는 우리나라 국가보안법이 정부수립 이후인 1948년 12월 제정된 이래, 7차례의 개정과 끊임없이 제기되어온 존폐 논란 속에 변천해 온 과정을 경로의존과 경로진화라는 역사적 제도주의의 관점에서 분석해 국가보안법(제도)이 현재에 이르기까지 어떻게 지속적으로 유지되어 왔는지 그리고 그 변화의 요인은 무엇인지를 규명함으로써 그에 따른 정책적 함의를 도출하고자 하였다. 분석 결과, 국가보안법은 경로의존 모형에서 제시하는 우연성과 결정적 시기를 계기로 경로가 시작되어 위헌성 소지(내부요인) 및 대내외 정세변화(외부요인)와 같은 외부적 충격에도 불구하고 부분적인 개정(경로변화)을 통해 이를 완화ㆍ흡수하면서 제정 당시 법 정신의 근간을 유지한 채 장기간 존속(경로유지)해 오고 있음을 알 수 있었다. 그리고 남북 간 긴장국면이 지속되는 상황에서 보수 세력의 지원을 바탕으로 강력한 정책옹호연합이 형성되어 있어 앞으로도 전면적 변화가 나타날 가능성이 낮을 것이지만 여전히 계속되는 개폐논란 속에 부분적인 변화는 지속될 것으로 전망되었다. 이는 국가보안법이 내부 및 외부의 변화요인 속에서도 오랜 기간 경로유지를 하고 있다는 점에서 단절적 균형모형으로 대표되는 경로 의존성의 전형적인 사례임을 의미하는 것이다. 또한 7차례의 개정과 한정합헌 판시와 같은 부분적인 변화가 나타났을 뿐 그 정체성을 이어가고 있다는 점에서 경로진화 모형 중 가겹에 해당하는 형태로 표출되었음을 알 수 있었다. 이는 경로진화 과정에서 보수 세력을 중심으로 한 정책옹호연합의 지원과 더불어 집권세력과의 정책이해 공유를 기반으로 삼아 외부적 장벽인 정치적 비토세력의 폐지요구를 극복한데 따른 것이기도 하다. 앞으로 국가보안법은 남북 간 긴장 국면이 지속되는 한 제도전환 없이 가겹 형태의 경로변화를 유지할 것으로 예상되며, 국내외 정세 및 한반도 안보환경의 변화와 기본권 보장과 관련한 국민인식 수준에 맞춰 법 적용을 해 나가면서 필요시 정부 주도 하에 선제적으로 법 개정작업을 해 나갈 필요가 있다는 정책적 함의를 도출하였다.
