이 논문의 목적은 공화주의와 인권의 결합을 타인의 자의적 지배로부터의 자유라는 개념을 통해 재조명하려는 시도들을 소개하고, 그러한 시도들이 민주적 심의와 보편적 인권의 길항관계를 극복하는 데 불 충분한 이유를 설명한 후, 자연적으로 부여된 권리가 아니라 민주적 심의를 통해 구성되는 것으로서 인권을 이해하는 ‘고전적’ 공화주의 전통에서 정치사회적 특수성과 인권의 보편성을 조화시킬 수 있는 원칙으로 비지배적 상호성을 제시하는 것이다. 최근 공화주의의 고전적 이해가 개인의 자율성과 집단의 공공성을 조화시킬 수 있는 적절한 형태로 주목받으면서, 정치사회적 또는 문화적 특수성이 인정되는 심의를 통해 인권의 내용을 구성하면서도 정치사회적 경계를 넘어 인권의 보편성을 확보할 수 있는 방편으로 공화주의와 인권의 결합을 살펴보는 연구가 활발하다. 그러나 새롭게 제시된 공화주의와 인권의 결합은 지금까지 인권 논의에 대해 고전적 공화주의자들이 비판해왔던 부분들을 보완하기에는 불충분하다. 한편으로는 인본주의적 공감을 개인적 동기 또는 선택의 문제로 환원시키는 오류를 범하고 있고, 다른 한편으로는 심의를 통한 인권의 구성보다 세계 시민사회의 건설이 목적으로 전치되는 결과를 초래하고 있는 것이다. 이런 문제의식에서 이 논문은 두 가지 과제를 수행한다. 첫째, 비지배 자유를 중심으로 공화주의와 인권의 결합을 시도한 이론들을 살펴보고, 그 이론들이 민주적 심의를 위한 최소 조건으로서 비지배가 갖는 정치사회적 특성을 충분히 살리지 못했다는 것을 밝힌다. 둘째, 반정초적이면서도 반상대주의적인 기준이 설정될 수 있다는 것을 키케로의 언술을 통해 설명한 후, 비지배적 상호성을 전정치적으로 주어진 절대적 기준에 호소하지 않으면서도 심의를 통해 정치사회적ㆍ문화적 경계를 넘어 적용될 수 있는 인권을 구성할 수 있는 조정원칙으로 제시한다.

다국어 초록 (Multilingual Abstract)

This paper aims to introduce various attempts to reevaluate the connection between republicanism and human rights with the conception of liberty as nondomination, to explain the reason that those attempts are insufficient to reduce the incompatibility of democratic deliberation with universal rights, and to present reciprocal nondomination as a regulative principle by which the universality of human rights could be in concord with sociopolitical particularities. Recently a number of scholars under the banners of republicanism have argued that in the republican tradition where human rights are comprehended not as naturally given but sociopolitically constructed, an appropriate account of human rights across sociopolitical and cultural borders could be justified. However, they did pay too little attention to deliberation with persuasion and nondomination through reciprocity, whereby the justification of human rights in the lights of republicanism are unduly reduced to individual motivation on the one hand and arguably transposed for the sake of building cosmopolitan civil society. By exploring the political justifications of humanitarian solidarity in classical republicanism with relation to human rights, I develop two arguments. First, critically reviewing various attempts to explain human rights in the lights of republicanism, I claim that too little attention has been paid to the sociopolitical meanings of nondomination as a minimal condition for democratic deliberation. Second, analyzing two distinct classical republican justifications for humanitarian solidarity, I argue that the politics of persuasion with reciprocal nondomination as a regulative principle may help us form another reasonable republican justification for human rights which is at once anti-foundational and anti-relativist.
