현행 부동산 전자계약시스템의 활성화 및 고도화 방안 = Activation and Advancement Plan for the Current Real Estate Electronic Contract System

국문 초록 (Abstract)

본 논문은 부동산 전자계약시스템의 현황, 문제점, 해외 사례, 발전 방안 및 고도화 방안을 종합적으로분석한다. 부동산 전자계약시스템은 중개사무소를 방문하지 않고 공인인증과 태블릿 PC를 이용하여 부동산 거래를 원스톱으로 체결하는 시스템이다. 전자계약서 생성 후 전자서명을 하면 확정일자가 자동 부여되고, 매매계약시 실거래신고도 자동으로 처리되어 안전성과 편리성이 높아진다. 그러나 사적 계약 내용이 정부가 운영하는 시스템에 보관된다는 점, 비대면 계약시 거래당사자의 의사무능력 여부를 확인하는것이 어렵다는 점 등 여러 단점이 지적된다. 해외 사례로는 미국의 MLS, 일본의 REINS, 유럽의 블록체인 기반의 거래시스템, 등이 있으며, 이는 부동산 전자계약시스템의 발전과 효율성을 입증한다.
논문은 부동산 전자계약시스템의 활성화 방안으로 이용증대 관점에서 UX 개선, 교육 프로그램 제공, 홍보 및 인센티브 제공을 제안한다. 또한 시스템 개선 및 보안 관점에서는 블록체인 기술 도입, 다중 인증방식 적용을 강조한다. 불법행위 예방 및 법규적 관점에서는 전자계약의 법적 효력을 명확히 하고, 법률정비를 통한 분쟁 예방을 강조한다. 고도화 방안으로는 블록체인 기술 도입을 통한 시스템의 탈중앙화, 보안성 향상, 스마트 계약 도입 등을 제안하며, 이는 부동산 거래의 투명성과 효율성을 높일 수 있다.
결론적으로 부동산 전자계약시스템의 활성화와 고도화를 위해서는 지속적인 노력과 법적, 기술적 보완이 필요하며, 이를 통해 부동산 거래의 투명성을 높이고 국민의 편의를 증진시킬 수 있다.

This paper comprehensively analyzes the current status, problems, overseas cases, development plans, and advancement plans of the real estate electronic contract system. The real estate electronic contract system is a system that allows real estate transactions to be concluded in one stop using a public authentication certificate and a tablet PC without visiting a brokerage office. After creating an electronic contract and signing it electronically, a confirmation date is automatically assigned, and actual transaction reports are also automatically processed when a sales contract is made, increasing safety and convenience.
However, several shortcomings are pointed out, such as the fact that private contract contents are stored in a system operated by the government, and it is difficult to confirm the willingness of the transaction parties when signing a non-face-to-face contract.
Overseas cases include the MLS in the US, REINS in Japan, blockchain-based transaction systems in Europe, and PEXA in Australia, which prove the development and efficiency of the real estate electronic contract system.
The paper proposes UX improvement, education program provision, promotion, and incentive provision as ways to activate the real estate electronic contract system from the perspective of increased use.
In addition, from the perspective of system improvement and security, it emphasizes the introduction of blockchain technology and application of multi-authentication methods. From the perspective of preventing illegal acts and legal regulations, the legal effect of electronic contracts is clarified, and dispute prevention through legal reorganization is emphasized. As a means of advancement, decentralization of the system through the introduction of blockchain technology, improved security, and introduction of smart contracts are proposed, which can increase the transparency and efficiency of real estate transactions.
In conclusion, continuous efforts and legal and technical supplementation are necessary to activate and advance the real estate electronic contract system, and through this, the transparency of real estate transactions can be increased and convenience for the public can be enhanced.
