造景的 側面에서의 土地利用ㆍ開發 計劃과 관련된 國內ㆍ外 法制度에 관한 考察 = A Review on the Domestic and Foreign Laws connected with Land Use &Development Planning from a view of Landscape Architecture

국문 초록 (Abstract)

本 硏究는 造景的 측면에서의 土地利用 및 開發 計劃과 관련하여 현재 적용되고 있는 國內法(법률 8종)과 수집된 國外法(법률: 18종, 조례: 1종, 판례: 13종)의 현황과 그 구체적인 내용을 살펴보았으며, 수집된 관련 국외법은 地域別ㆍ國家別로 정리하였다. 수집된 국내ㆍ외 관련 법규를 法條文상의 內容을 기준으로 하여 造景的 측면에서의 土地利用 및 開發 計劃의 基本原則 및 槪念, 類型 및 形態, 관련 權利, 許容 및 規制 行爲, 行政節次 및 制度 등의 項目別로 分類하여 比較ㆍ分析해 봄으로써 여러 법률에 산재해 있는 관련 法規들에 대한 相互 關聯性을 考察해 보았다.

This study was conducted to grasp the present condition of the name and the related text of the domestic laws(8 statutes) in force which were connected with land use & development planning from a view of landscape architecture and the related foreign laws(18 statutes, 1 ordinance, 13 leading cases) were arranged in the name and the text and classified by nations of regional groups.
To make the text of the collected domestic and foreign laws a comparative analysis of the principle and concept, the type and form, the related rights, the permitted and restricted acts and the administrative process and systems of land use & development planning from a view of landscape architecture by items, it was considered to the mutual relation with lots of laws which are scattered with the various laws and use & development planning from the other departments and carry out the advanced land use works in landscape architectural point.
