광역 VTS 도입을 위한 입법론적 연구 = An International Legislative Study on the Introduction of Transnational VTMIS

국문 초록 (Abstract)

  해상교통관제(VTS)가 국제적으로 성공하기 위해서는 국제법적인 근거를 확보해야 하는 바, 상위법인 1982년 유엔해양법협약의 기본정신에 따라 IMO 차원의 국제협약 또는 이해관계를 같이 하는 지역적 협약이 마련되어야 하며, 이를 기초로 하는 국내 이행 입법이 도입되어 법적 실효성을 확보해야 한다. 특히 국내 VTS를 활성화하고 이를 기초로 주변국가간 협력체제를 통한 광역 VTS(VTMIS)의 도입으로 연안국의 관할권을 벗어나는 수역에서의 해양사고 발생을 미연에 방지함은 물론 사고선박에 대한 해난구조 체계를 효과적으로 운영하기 위한 사전 예방적 및 사후 구제적 차원의 국제법적 제도의 도입이 필요하다. 이러한 지역적 협약에는 관련국들에게 부과되는 사전예방의 의무, 정보제공의 의무, 협의의 의무, 원조의 의무 등이 포함되어야 할 것이다.

다국어 초록 (Multilingual Abstract)

  Vessel Traffic System(VTS) can be succeeded on the basis of the international legal grounds such as the IMO(International Maritime Organization) Maritime Conventions or regional conventions between the interested countries according to the basic sprit of the United Nations Convention on the Law of the Sea(UNCLOS). On the other hands, it is necessary to introduce the VTMIS(Vessel Traffic Management and Information System) through the corporation among the neighboring States in order to prevent marine casualties and operate the SAR(Search and Rescue) system efficiently for the accidental vessels in waters beyond the jurisdiction of the coastal States. In conclusion, I suggest that it is urgent to establish and carry out regional corporation including precautionary and relieving measures within Northeast Asian Seas as soon as possible. And also concerned States should be imposed upon duties such as an obligation to the obligation to inform, an obligation to consult, a obligation to assist, and etc.
