범죄예방망(CPN)구축을 통한 아동성폭력 예방대책 = The Prevention Measures of Child Sexual Assault Through Crime Prevention Net(CPN)

국문 초록 (Abstract)

아동성폭력 문제가 심각한 사회문제의 하나로 떠오르고 있다. ‘조두순사건’, ‘김수철사건’ 등 충격적인 사건이 근 몇 년간 연이어 발생했기 때문이다. 정부에서는 이에 대한 대응으로 갖가지 대책들을 내 놓거나 기존의 대책들을 강화하였다. 관련 법령의 처벌조항의 강화, 전자감시제도, 범죄자의 신상공개제도, 화학적 거세조치를 비롯하여 학생안전 강화학교의 지정, 배움터지킴이제도, CCTV의 설치 강화, 범죄예방 홍보활동, 문자알림서비스, 아동안전지킴이 위촉, 아동안전 수호천사의 위촉 등이 그 예이다. 그러나 이러한 대책들은 다분히 캠페인적 성격이 짙거나 아니면 이미 범죄가 발생한 후 그 범죄자의 처벌 또는 재범억제를 위한 대책에 불과하다. 범죄발생 원인에 대한 세밀한 분석 후 보다 체계적이고 과학적인 범죄예방대책이 세워져야 함에도 불구하고 다소 현시적인 대책만을 내놓을 뿐이다.
따라서 본 논문에서는 범죄발생의 원인을 기존의 범죄학 이론에 따라 세 가지 영역으로 구분하여 살펴본 후, 이 세 가지 영역에 대한 대책을 범죄예방망(CPN)이라는 개념을 통하여 통합적 범죄예방대책을 제시하고자 한다. 먼저 범죄발생 원인에 따른 범죄예방영역을 세 가지로 구분해 보면 그것은 크게 범죄적 경향성 억제영역, 범행기회 억제영역, 재범 억제영역으로 나눌 수 있다. 범죄적 경향성 억제영역에서는 범죄인에 대한 신속ㆍ확실ㆍ엄격한 처벌을 통한 일반 억제전략, 치료를 요하는 개인에 대한 의료ㆍ심리치료, 문제 있는 가정에 대한 조기개입전략, 학교개입전략, 지역사회의 조직화 등을 통하여 사회구성원들이 범죄적 경향성을 가지지 않도록 하는 정책들이 필요하고, 범행기회 억제영역에서는 환경설계를 통한 범죄예방, 방범진단, 정복경찰관의 순찰빈도 강화를 포함하는 각종 위험방지작용, 범죄예방홍보활동, 보안점검, 범죄대상물의 보호강화, 재물등록, 청소년 보호활동, 범죄유발환경에 놓인 종사자들에 대한 교육 및 보호, 일반적 피해예방 교육 등을 통하여 잠재적 범죄자가 범행을 할 수 있는 상황적 기회를 차단하는 정책들이 필요하며, 재범 억제영역에서는 범죄자에 대한 의료ㆍ심리적 치료, 교육 및 직업훈련, 보호관찰대상자 및 우범자 등에 대한 관리정책 등을 통하여 범죄자가 재차 범죄를 저지르지 않도록 하는 정책 등이 필요하다.
이러한 영역 별 범죄예방 대책들을 효율적으로 실행하기 위해서는 각 전략에 필요한 정부기관 및 공공기관을 의무적으로 참여하게 하여 이들 기관 간에 촘촘한 그 물구조를 형성하는 연계망이 필요하다. 이러한 연계망을 범죄예방망(CPN)이라 명명하며 범죄예방망에 의무적으로 참여하는 기관들의 회합체인 가칭 범죄예방위원회는 지방정부 소속하에 설립한다. 범죄예방은 경찰과 지방정부의 공동임무이나 경찰이 현재 국가경찰제를 취하고 있는 현실에서 는 지방정부가 범죄예방의 적극적인 주체로 나아가야 한다는 점에서 범죄예방위원회를 지방정부 소속하에 두는 것이 필요하다. 또한 범죄예방망을 구축하고 운용하고 조정하는데는 반드시 범죄예방망 조정관 (CPN coordinator)이 있어야 한다. 범죄예방망 조정관은 범죄전문가로 임명되어야 하며 지방정부 소속으로 가칭 범죄예방위원회를 실제 운용할 수 있어야 한다. 이렇게 범죄예방망을 중심으로 범죄예방의 어느 영역도 빠짐없이 그에 적절한 대책을 세워야만 보다 근원적으로 아동성폭력문제가 해결될 수 있을 것이다.

다국어 초록 (Multilingual Abstract)

The issue of child sexual assault is emerging as one of serious social problems. The reason is that the shocking cases such as ‘cho doo-soon case’ and ‘kim soo-chul case’have occurred serially for the fast two years.
To settle this problem, the government have set up various kinds of new measures or enhanced the existing measures. For example, heavier punishment, electronic surveillance, disclosing sex offender information to public, chemical castration, school police, etc. However, these are kind of campaign-like or post-providing measures. While the government needs to set up systematic and scientific crime prevention measures after
detailed and micro analysis of crime caution, it shows kind of self-dramatizing measures to public.
This article will present that integrated crime prevention system through the ‘crime prevention net(CPN)’. The Crime Prevention Net(CPN) means an integrated model for crime prevention that forms the structure like a close meshed net by making use of the various crime prevention strategies and by collaborate participation of multi-groups. This CPN Model includes three realms, namely the realm of criminal-tendency deterrence, the
realm of the criminal opportunity reduction and the realm of recidivists management.
The strategies in criminal-tendency deterrence realm are the treatments for individuals with biological or psychological predisposition to crime, the interventions in the process of individual’s socialization and the developments of the overall social structure andsurroundings. The criminal opportunity reduction strategy is situational crime prevention strategy, such as CPTED, teaching techniques to avoid being a victim of crime, formal surveillance by policemen’s patrol and so on. The recidivists management strategies are the management of information of recidivists, parolees and offenders who are under the probation.
The CPN is constructed by the obligatory participants and the various strategies. And the crime prevention coordinator plays a central role in the CPN : searching and analyzing on the criminal environment in the community, finding accurately the capable resources in the community, selecting participants which forms CPN, designing CPN suitable to the community, coordinating the function of participants, educating the strategies of crime prevention to the participants.
