This paper examined the logical validity of discoursive ethics presented by Karl-Otto Apel. Based on transcendental pragmatics and transcendental hermeneutics, Apel argues that one can construct ethical norms in the ideal communitive situation without falling into logical trilemma(justification involves either an infinite regress, a petito principii, or the dogmatic acceptance of a first axiom). Also, prerconditions of ideal communicative situation cannot be avoided either by skeptics or relativist without committing performative inconsistency. However, this paper argues that these preconditions are not unavoidable because these premises are also open to revision by rational criticism.
