해양석유시추로 인한 유류오염사고 대비 및 대응에 관한 우리나라 법제 개선방안 = A Study on the Improvement of Korea Legal System of the Preparedness and Response against Oil Pollution Accident from Offshore Drilling

국문 초록 (Abstract)

이 연구는 우리나라 동해의 배타적 경제수역에서 2012년 7월부터 해양석유시추작업을 수행하고 있는 상황에서 해양석유시추작업의 해양환경관리에 관한 현행 법률을 검토한 것이다.
우리나라 국내법 분석과 외국사례 검토를 통해 해양석유시추작업에 관한 효과적인 해양환경관리를 위한 국내법제 정비방안을 다음의 요지로 제시했다. 첫째 해양환경관리법에서 해양석유시추선에 대한 해양환경관리를 다루어야 하고, 둘째 해양석유시추선의 소유자에게 방제선박 및 기자재의 비치를 의무화하여야 하고, 셋째, 해양석유시추시설에 의한 해양오염방지를 위해 해양시설 오염비상계획서의 작성·비치를 의무화하여야 한다.

다국어 초록 (Multilingual Abstract)

This article is for analyzing the current legal system for the management of marine environment in a special consideration of the offshore drilling campaign from July in the East Sea Exclusive Economic Zone(EEZ) of the Republic of Korea. Based on the analyses of domestic and foreign cases, the author recommended the reinforcement of national legal regime for the effective management of marine environment against the offshore drilling activities, main points of which are as follows. ⅰ) The provisions of the Marine Environment Management Act shall apply to the management of the marine environment in the mobile offshore drilling unit(MODU); ⅱ) The owner of a MODU shall place pollution response vessel and equipments in sea areas. ⅲ) The owner of a MODU shall prepare a offshore facility oil pollution emergency plan against marine pollution by MODU
