미국의 공공건축 설계서비스 조달의 법제도의 특성과 시사점 = A Study on U.S.'s Procurement System for Architects-Engineers Services

국문 초록 (Abstract)

본 연구의 목적은 우리나라의 건축설계 공공 조달과 관련된 법ㆍ제도의 개선점을 위한 시사점을 도출하기 위해 미국의 건축설계 공공 조달과 관련된 법과 제도를 살펴보고, 그 속에 담긴 의미와 논리, 철학을 이해하여 이들이 어떻게 하위 규정에서 운영주체의 방침을 이루고 있는지를 이해하는 데 목적이 있다. 미국은 1972년 건축설계 공공 조달에서 가격경쟁을 금지하고 협상을 통하여 가격을 결정하는 내용의 브룩법을 제정하여 일반 제품과 서비스와는 별도의 조달제도를 마련했다. 이 같은 원칙의 조달제도가 지금까지 40년이 넘는 기간 동안 정착되어 활용되고 있는 이유로 건축설계업의 특수성에 대한 이해를 바탕으로 여러 법제도에서 일관되고 폭넓게 적용될 수 있는 건축설계의 법적 정의를 확보하고, 설계자의 능력을 평가함에 있어서 정량적인 기준 이외에 정성적인 부분을 심사할 수 있는 인터뷰, 협상과 같은 방법을 마련한 점 등을 확인했다.

다국어 초록 (Multilingual Abstract)

The purpose of this study is to draw a lesson for the public procurement system for architectural services in Korean through the studies of the public procurement system for architectural and engineering services in U.S. To understand U.S. procurement system, it explored the QBS(Qualifications Based Selection) and the legal bases for the QBS use. The federal government passed the Brook Act in 1972, which outlined the qualifications based selection process, for the alternate source selection methods in public procurement of architectural and engineering services. QBS, basing selection on qualification and competence, was adopted to fosters greater creativity and flexibility of the services and increases the overall value of the project. To understand how the idea of the Brook Act is conducted pubic agencies, this study analysis United States Code, Federal Acquisition Regulations and General Services Administration guidelines related to the public procurement of the architectural and engineering services.
