반사회적 행동(Anti-social Behaviour) 및 이에 대한 정책적 대응방안에 관한 연구

국문 초록 (Abstract)

본 연구는 현재 중요한 사회문제가 되고 있는 반사회적 행동을 적절하게 개념화하고, 서구 선진국에서의 반사회적 행동에 대한 정책적 대응방안을 영국의 반사회적 행동에 대처하기 위한 종합적 평가서인 동시에 계획서인 Respect and Responsibility: Taking a Stand Against Anti-Social Behaviour를 사례로서 분석하며, 이를 토대로 우리나라에서 반사회적 행동에 대처하기 위한 정책방안을 모색하려는 것이다. 즉, 본 연구는 아직 국내에 제대로 소개되어 있지 않은 반사회적 행동에 대한 연구를 이론적으로 체계화하고, 외국의 사례와 우리의 현실분석을 토대로 반사회적 행동에 대처하기 위한 정책적 대응방안을 제시하려는 것이다.
분석 결과, 전반적으로 우리의 경우는 아직 반사회적 행동의 개념에 대한 이해가 부족하며, 따라서 이에 대처하기 위한 법제, 행정조직, 프로그램, 대응전략 등도 아직 체계화되어 있지 못하다. 법제적인 측면에서는 반사회적 행동과 관련한 다양한 법제들이 분산적으로 관리되고 있으며, 행정체계도 파편화되어 있다. 지역단위에서도 행정기관들 간의 연계성 부족으로 인한 과잉단속 등이 발생하고 있다. 무엇보다도 반사회적 행동의 유형별 혹은 연령대별로 차별화된 처방책을 강구하지 못하고 있다. 대응전략 면에서도 대부분이 예방이나 선도보다는 처벌 위주가 되고 있다. 따라서 반사회적 행동에 효과적으로 대응하기 위해서는 이론적 관점의 정립, 법제정비, 행정시스템 구축, 지역거버넌스에 입각한 공사 역할분담, 탄력적인 대응전략의 모색, 현장역할의 강화, 대처방안의 적실성 제고, 집행과정의 일관성 확보 및 재량남용 방지 등이 필요하다.

다국어 초록 (Multilingual Abstract)

The aim of this study is to conceptualize the term 'anti-social behaviour(ASB)' and to suggest adequate policy responses to ASBs, by analyzing the UK case study on Respect and Responsibility: Taking a Stand Against Anti-Social Behaviour and the contemporary conditions of regulations and the administrative system to tackle ASBs in Korea. As a result of analysis, this article found that Korean academic and practical circles pay very little attention to the analysis of ASBs and thus they are very poor in suggesting the policy responses to ASBs. Fragmented regulations and administrative systems are ineffectively in tackling ASBs. At the community level, resident are suffering from over-regulation, due to the lack of coordination between related administrative institutions. Above all else, responses to ASBs produce rigidity and inadequacy, as they cannot take into account of the types of ASBs and the age groups of predators. Strategies to tackle ASBs are also mainly dependent on punishment, neglecting the methods of education, consultation, and guidance. Thus, this article suggests the following as policy responses to ASBs: establishing integrative theoretical perspectives, organizing the legislative system, founding the efficient administrative system, assigning the roles between public and private actors, exploring flexible response strategies, strengthening on-the-spot responses, improving the relevance of policy responses, securing the consistency of implementation, and controlling the abuse and misuse of administrative discretion.
