독일의 아동복지 정책과 관련 법제 연구 -정부의 양육지원 제도를 중심으로-

국문 초록 (Abstract)

저출산과 고령화현상은 현재 우리나라 뿐 만 아니라 전 세계가 해결해야 할 과제라고 할 수 있다. 독일도 예외는 아니어서 출산율 회복을 위한 법적, 제도적 노력을 꾸준히 시행하고 있다. 출산율 증가를 위해서는 다양한 양육정책과 가족복지적 측면에서 국가적 차원의 지지가 필요함을 인지하고 입법을 통한 지원도 아끼지 않고 있다.

최근 독일의 출산율의 상승은 독일인들에게 아동양육을 위한 아낌없는 정부 정책과 지원의 결과라고 여기게 되었다. 독일의 출산장려정책은 노동법 및 사회보장제도를 가족친화적으로 개선하고, 보육시설을 확충하여 직장과 자녀양육을 병행할 수 있도록 지원하는 데 초점을 맞추고 있다. 결국 출산율을 높이고 인구구성비의 불균형을 해소하는 전제조건은 가족친화적 법제, 노동시장에서의 남녀에 대한 평등한 대우, 전통적인 남녀관 내지 결혼관의 타파, 결혼제도에 대한 각종 특혜의 폐지, 영유아에 대한 공공보육시설의 확충 등이라고 할 것이다. 아동양육에 대한 국가적 차원의 정책과 제도적 마련이 무엇보다 중요하다고 할 수 있는 것이다.
우리나라도 최근 들어 아동수당에 대한 논의가 있으나 국가재원을 이유로 적극적인 자세를 취하고 있지 않는 실정이다. 인구절벽, 저출산의 문제는 개인적 차원에서는 절대 해결할 수 없는 과제이다. 이에 정부의 적극적인 양육지원 정책과 법적 토양마련만이 출산율을 높이고, 미래의 대한민국이 인구절벽의 마지막 낭떠러지에 처하는 상황을 해결할 수 있는 하나의 방법이 될 수 있을 것이다.
