절차참여권을 결여한 통관검사에 대한 위법성의 판단 = On the Judgement of Illegality of Customs Clearance that Lacks the Right to Participate

국문 초록 (Abstract)

관세행정은 조세징수, 수출입화물의 통관 적정화, 부정무역의 단속이라는 규제적 행정이 주류를 이룬다. 행정단계마다 납세자의 권익이 소홀히 취급될 개연성이 많은 행정이다. 그래서 관련 법령, 고시?훈령에서 광범위한 납세자의 절차적 참여를 보장하고 있다. 그런데도 가끔은 절차적 권리를 침해당했다고 행정구제를 요청하는 경우도 있다. 이 사건을 법원에서 납세자의 권익이 침해당한 것으로 인정한 것은 다행한 일이다. 그러나 아직도 관세행정에서 소홀하게 취급되는 납세자의 권리에 대한 관심과 주의가 필요하다.

다국어 초록 (Multilingual Abstract)

The mission of Customs administration mainly consists of regulatory one, such as tax collection, appropriate customs clearance of importing and exporting cargo and controlling unfair trade. The right of taxpayers is likely to be neglected in each procedure. Therefore a lots of related statutes like instructions and notices broadely guarantee the participation right of taxpayers in administrative procedures. However, sometimes taxpayers file a suit insisting violation of their rights. It is fortunate of the court to rule that the right of taxpayer had been violated in this case. Nevertheless we still have to pay attention to the taxpayers' right which is treated neglectfully in customs administration.
