중국 최고인민법원의 사법해석제도 검토 = The Judicial Interpretation System of the Supreme People's Court of China

국문 초록 (Abstract)

본 논문은 중국 최고인민법원의 사법해석권 행사와 관련되는 사법해석제도를 검토하여 그 제도적 특징이나 문제점을 구체적으로 파악하고자 한다.
중국의 최고인민법원은 최고 재판기관으로서 구체적 사건의 판결을 전제로 법률의 해석을 위한 사법해석권한을 행사하고 있다. 그러나 최고인민법원의 사법해석권 행사는 현대적 법치주의의 관점에서 보면 많은 여전히 문제점을 안고 있는 것도 사실이다. 즉, 최고인민법원이 내리는 사법해석이 입법기관의 기능을 담당하는 형국이 되기도 하고, 최고인민검찰원 또는 기타 중앙 행정부서와 공동으로 내려지는 경우도 많아 독립된 사법기관에 의한 법 해석이 이루어지 못하는 경우가 있으며, 경우에 따라서는 법관의 독립이라는 원칙을 훼손하고 있다.
그러나 현실적으로 최고인민법원의 사법해석은 재판에서 중요한 기준이 되고 있다. 최고인민법원의 법률에 대한 사법해석은 유사사건에 있어서 중요한 법원으로서 역할을 하고 있고, 하급법원의 판결에서 해석상 논란에 될 수 있는 규정에 대하여 국가적으로 개관적 통일성을 유지한다는 점에서는 중요한 의의가 있다고 할 것이다.
결론적으로, 본문의 내용과 같이 중국 최고인민법원의 현행 사법해석제도는 여러 가지 장점과 단점을 모두 내포하고 있다. 향후 중국 법제 현대화의 진전과 함께 입법기관의 입법기능의 강화와 제도적 발전을 기대한다.

다국어 초록 (Multilingual Abstract)

This thesis focus on the system of judicial interpretation which it about exercise the power of judicial interpretation of the Supreme People's Court of China, and we could comprehense some features and matters of this system.
As the highest court in China, the Supreme People's Court exercise the power of judicial interpretation for judge in the specific suit case. But, in the modern constitutionalism views, it is true that the exercise of the power of judicial interpretation of the Supreme People's Court causes or implies various matters. For example, in some times, judicial interpretation of the Supreme People's Court act as a substitute for legislative function, and in many case, the Supreme People's Court exercise the power of judicial interpretation with the Supreme People's Procuratorate or other administrative authorities, so it is to say that not real independent judicial interpretation of the Supreme People's Court, moreover it defames the principle of judicial independence of judicial office.
No matter how, actually, judicial interpretation of the Supreme People's Court is one of the most important criteria in judge. Judicial interpretation of the Supreme People's Court play an important role as a key source of law in the same kind of case, especially in low level court's trial, and it guarantee a unity of law interpretation in China.
In conclusion, modern judicial interpretation system of the Supreme People's Court of China includes various merits and faults. Hereafter, we hope that more evolution of the judicial interpretation system, and recovery the function of legislative organ in China.
