외국인테러전투원과 유럽평의회테러방지협약 = Foreign Terrorist Fighters and the Council of Europe Convention on the Prevention of Terrorism

국문 초록 (Abstract)

2006년 이슬람국가라는 극단주의 테러단체 등장 이후 외국인테러전투원의 문제가 국제사회가 당면한 국제법상의 중요한 이슈로 제기되게 되었다. 유엔 안전보장이사회 결의 2178호가 결정적 계기가 되었다. 유럽평의회는 이 문제에 대처하기 위해 2015년 테러방지협약추가의정서를 채택하여 외국인테러전투원의 테러 참가를 억제하기 위해 여러 가지 범죄를 신설하였다. 이는 국제형사법상 대테러 대응과 관련해서 괄목할 만한 진전이라고 평가할 만하다. 2016년 제정된 우리나라의 테러방지법은 외국인테러전투원에 관한 몇몇 규정을 두고 있기는 하다. 하지만 충분히 만족스러운 정도는 아니다. 따라서 향후 테러방지법을 개정할 경우, 이 법에서 테러목적의 훈련 이수, 테러목적의 해외이동, 테러 목적의 해외이동 경비 지원 등을 명문으로 금지하는 방안을 적극 고려해야 할 것이다.

다국어 초록 (Multilingual Abstract)

After the show up of "Islamic State(IS)", one of extremist terrorist organizations in 2006, foreign terrorist fighters(hereafter abbreviated as FTF) issues were raised as important pending problems facing the community of nations under international law. The United Nations Security Council Resolution No. 2178 gave a decisive momentum. To cope with these matters, Council of Europe newly established diverse crimes to restrain FTF from participating in terrorist activities by adopting “Additional Protocol to the Council of Europe Convention on the Prevention of Terrorism” in 2015. This means an outstanding progress especially in relation to counter-terrorism in international criminal law. South Korea's "Act on Anti-terrorism for the Protection of Citizens" enacted in 2016 has some provisions on FTF. But they are not satisfactory. When the ROK government push forward revising the 2016 Anti-terrorism Act, it should actively consider introducing articles expressly banning such FTF's unlawful acts as training for terrorism, receiving training for terrorism, travelling abroad for the purpose of terrorism, funding travelling abroad for the purpose of terrorism etc.
