각국의 스포츠산업 진흥관계 법률에 대한 고찰 = Legal Aspects and considerations related to the Law of Sports Industry in Asia and the U.S.

국문 초록 (Abstract)

이 연구의 목적은 첫째 스포츠산업에 대한 국가의 관여 정도를 검토하고, 둘째 우리나라를 비롯한 주요국가의 스포츠산업 진흥관계 법률을 비교, 고찰하고, 각국의 스포스산업 진흥관계 법률의 특징을 탐색하는데 연구의 목적이 있었다. 스포츠산업은 그 대상인 스포츠에 의하여 범위가 확정된다는 점에서 스포츠에 대한 권리는 스포츠산업과 밀접한 관련이 있다. 스포츠인과 스포츠단체, 또는 스포츠와 관련하여 기본권의 차원에서 스포츠산업과 관련되는 것에는 경제적 기본권이라 불리는 것들이 있다. 스포츠산업 진흥관계 법률과 관련하여 미국이나 일본은 규제완화와 정부개입최소 그리고 일반 법령과의 관계 속에서 스포츠산업이 규제 및 보호받고 있다. 공정한 경쟁의 장(場)만 국가가 만들어 주고 민간의 자유경쟁을 유도하고 있다. 진입장벽이 낮다고 할 수 있다. 중국은 스포츠산업의 성장과 사회발전 속도를 모법(母法)인 “중화인민공화국 체육법”과 일반 관계 법령이 따라가지 못하는 상황이다. 제도적인 문제는 국가의 개입이 필요하며, 법령정비를 통해 스포츠산업 발전에 제도적 기반을 마련해야 한다. 우리나라도 “스포츠산업진흥법” 및 스포츠관련 법률의 조항 중에서 추상적이거나 선언적 의미가 강한 조항들은 수정 보완 될 필요가 있었다.

다국어 초록 (Multilingual Abstract)

The purpose of this study was to explore and discuss about legal issues and aspects related to the law of sport industry in Asia and the U.S. This paper examined the real situation related to the sports law several country. The background and current situation are analysed and future recommendations were made. The paper also attempted to discuss factors contributing to the circumstances and endeavor to imply possible solutions. The research method was based on the literature review. The results and suggestions of this paper are as follows: First, China needs to approach new paradigm related to the sports law. The Athletics Law of People Republic of China is much more like an administration law. To promote the sport industry law system, China needs not only to modify this code, but also needs to draft series of law, along with the other laws, which have been promulgated. Second, Sports law in the United States is not a single or specific legal discipline, nor does it comprise and discrete substantive legal area. Rather it is defined by the identity and needs of its clients. Japan has not intervened the sport industry basically. The development and advance of sports law depend on private business and system. Korea government in April, 2007 passed the Sports Industry Law to promote sport field which lead future economy. It will be milestone in Korea sport industry. In conclusion, sports has become more than recreational or avocational activity. It is now part of big business on global scale. Sports significantly contributes to the increase of the gross national product of a country and plays an important role in international.
