지급이체의 법률관계 = Legal Relations in Fund Transfer - Framework for Analasys of Mistaken Transfer -

국문 초록 (Abstract)

최근 들어 착오 송금이나 무권한 거래와 같이 지급이체 과정에서의 하자가 법적 분쟁으로 비화하는 경우가 늘어나고 있다. 이러한 문제들에 대한 해결방안을 단순히 직관에 호소하는 것을 넘어서 법적으로 설득력 있게 제시하기 위해서는 먼저 지급이체의 복잡한 법률관계를 체계적이면서도 엄밀하게 분석할 필요가 있다.
이를 위하여 본고는 지급이체의 법률관계를 세 가지 관점에서 검토하였다. 먼저 지급이체가 가진 기능적 측면에 주목하여, 지급결제제도로서의 기능과 그 실제적 구성을 관찰하였고, 다음으로 개별적인 법률관계에 주목하여, 지급이체와 관련된 각 당사자들 사이의 법률관계를 살펴보았으며, 마지막으로 전체적인 법적 구조에 주목하여, 지급이체 과정에서의 하자를 원인관계의 하자와 지시의 하자라는 지시삼각관계 부당이득 법리의 틀 안에서 분석할 수 있음을 보여주고자 하였다.
이러한 세 가지 관점은 서로 영향을 미치며 보다 완결성 있는 분석을 가능하게 한다. 예를 들어 지급이체의 지급결제제도로서의 기능적 특성은 입금기장의 추상성의 근거로 작용함으로써 수취인과 수취은행의 관계를 비롯한 지급이체 과정에서의 개별적 법률관계의 분석에 도움을 주는 한편, 지시삼각관계의 부당이득 법리를 지급이체의 법률관계에도 원용할 수 있는 근거를 제공함으로써 전체적인 분석을 가능하게 한다. 이러한 분석틀은 지급이체 과정에서 나타나는 여러 문제들을 전체적 구조에 입각하면서도 세부적 요소들을 놓치지 않은 채 일관성 있게 검토할 수 있도록 도움을 줄 수 있을 것이다.

다국어 초록 (Multilingual Abstract)

There has been a rise in cases where failure in fund transfer such as mistaken transfer and unauthorized transfer turns into legal dispute. It is needed to tackle complex legal relations surrounding fund transfer both systematically and thoroughly to provide solutions which is not only intuitive but also legally persuasive.
To this purpose, this article examines legal relations in fund transfer from three vantage points. Firstly, it turns to functional aspect and observes the function of fund transfer as payment system and its actual structure. Secondly, it pays attention to the micro-level legal relations and deliberates the legal relations between relevant parties. Lastly, it notices macro-level legal structure and attempts to show that failure in fund transfer could be analysed within the frame of unjust enrichment in three-cornered relation(Anweisungsverhältnis), which relates the failure in causal relation and failure in instruction(Anweisung).
These three perspectives intertwine with each other and enable refined analysis. For example, the functional aspect of fund transfer as payment system acts as ground for the abstract nature of book entry and helps micro-level analysis of legal relations in fund transfer including relation between payee and recipient bank, and enables macro-level analysis by providing ground on which theory of unjust enrichment in three-cornered relation can be applied to fund transfer relations. This frame could help coherent examination of various problems arising from fund transfer which is based on overall structure while not overlooking details.
