국문 초록 (Abstract)

1990년대 중반부터 북한이탈주민의 국내입국이 본격화된 이래 2010년 현재 그 수가 2만명 가까이 이르고 있고 앞으로도 그 증가 추세는 지속될 것으로 예상되고 있다. 입국인원 증가추세에 발맞추어 정부는 북한이탈주민들이 우리사회에 조기에 정착할 수 있도록 다양한 정책적 지원을 실시해 왔다. 2008년부터는 하나원 시설을 확충하는 한편 취업문제 해소를 위해 노동부, 기업 등과 연계하여 ‘북한이탈주민 일자리 창출 사업’을 적극적으로 추진해 왔다. 그런데 북한이탈주민은 대한민국 사회의 법제도에 익숙하지 않아 본의 아니게 법을 위반하기도 하고 때로는 피해를 당하기도 한다. 이와 같이 북한이탈주민들은 한국사회 정착과정에서 부딪히는 많은 법적 문제들로 인하여 어려움을 겪고 있는 것으로 조사되었다.
그 동안 관련 정부 부처와 NGO단체에서는 북한이탈주민의 법적 애로를 해결해 주기 위하여 북한이탈주민 정착지원시설(하나원)에서 생활법률을 강의해 왔으며, NGO단체는 법률상담 코너를 마련하여 소비자분쟁 상담 및 법률서비스를 지원해 왔다. 그럼에도 불구하고 대한민국의 한 국민으로서, 또는 소비자주권자로서 북한이탈주민은 자본주의국가에서 거래되고 있는 상거래 및 법률관계에 대한 이해가 부족할 뿐만 아니라, 법의식 조차 없는 경우가 많다는 지적이 있어 왔다.
본 논문에서는 대한민국 헌법상 소비자주권자인 북한이탈주민들이 자본주의사회에서의 시장경제 활동의 주체자로서 계약의 자유와 책임에 대한 이해를 폭넓게 하기 위해서는 ｢소비자보호법｣에 대한 교육이 중요하다는 점을 지적한다. 북한이탈주민에 대한 소비자보호 법교육은 어떠한 의의가 있는지, 그리고 왜 필요한지 물음에서 출발하고자 한다. 나아가 소비자보호 법교육의 실태와 법제도적 개선방안 등에 대해서도 언급하고자 한다.

다국어 초록 (Multilingual Abstract)

Since the entry of North Korean defectors into South Korea was in full swing from the mid-90s, the number of defectors has increased nearly to 20,000 and the trend is expected to continue in the future. The government has conducted various strategic supports for them to settle as soon as possible in our society to keep pace with the increased trend of their entry into South Korea. In addition, it has aggressively pursued 'the project of creating jobs for the North Korean defectors' in connection with businesses and the Ministry of Labor to address employment problems while expanding the facilities in 'Hanawon" from 2008. However, since North Korean defectors were not familiar with the legal system in the Republic of Korea, they unintentionally violated the law and were sometimes victims of the law. Thus, it was found that North Korean defectors have had many difficulties, owing to the legal problems faced them, while settling in South Korean society.
In the meantime, the relevant government departments and NGO groups have lectured on the life law to help them to solve legal difficulties in the settlement support center for North Korean defectors (Hanawon) and NGO groups have provided consumers dispute counseling and legal service through legal counseling center. Nevertheless, it has been pointed out that not only do North Korean defectors lack a realistic understanding of the commerce & legal relationship in a capitalist country, as a nation or a consumer-sovereign, but also they don't have even legal consciousness.
This paper aims to point out the importance of education of "Consumer Protection Act" for the defectors as consumer-sovereign to have a broad understanding of the freedom of contract and the responsibility as a main agent in the market economy. This paper starts from the questions, "what significance is there in the education of consumer protection, and why is it needed?". Furthermore, what will be discussed in this paper is as follows: The reality in the education of consumer protection law and the way to improve legal institution.
