루소의 도덕과 법 : 개념과 관계

국문 초록 (Abstract)

이 글은 루소의 정치사상에 있어서 첫째, 도덕(moeurs) 개념을 정의하고, 둘째, 지식론과의 관계를 살펴봄으로써 도덕의 발생경로를 드러내며 셋째, 도덕과 법의 관계가 어떻게 설정될 수 있을지를 살펴보고자 하였다. 그 결과, 도덕은 이성과 감성에 의해 인간에 대하여 형성한 관계관념과 관계감정이며, 인간관계 속에서 습관, 예절, 관행, 관습 등으로 나타난다는 것을 밝혀내었다. 이러한 도덕들은 그 사회의 인간관계를 도덕관계로 그리고 그러한 관계들이 확장된 도덕관계망을 형성하고 유지하며 결속시키는 기능을 하게 된다. 이러한 관계들을 규율하는 질서로서 법은 이런 도덕들을 반영하게 된다. 따라서 개인적 차원의 도덕이 덕을 반영하고 있다면 그 사회의 도덕들은 좋은 도덕들로 나타나게 될 것이고 그로부터 도출된 법은 자연법의 지위를 부여받을 수 있게 되지만, 반대로 덕을 반영하고 있지 않다면 그러한 도덕들과 그에 기반한 법은 오히려 사람들을 구속하는 인위적인 족쇄에 불과하게 된다. 따라서 루소는 개인과 사회의 도덕들이 덕을 반영할 수 있는 근본적인 방법으로서 교육론, 『에밀』과 이미 타락한 도덕들을 가진 사회가 좋은 도덕들을 가질 수 있도록 하는 차선의 방법으로서 제도론, 『사회계약론』을 제시하게 된 것이다.

다국어 초록 (Multilingual Abstract)

This study has three aims, the first is to conceptualize the meaning of morals(the French, moeurs) the second is to trace out its path of genealogy to laws, and the third is to articulate the relationship of morals to laws. As the results, morals can be conceptualized as the relative ideas and sentiments by reason and senses. In the relationships of men, by language and behaviour, morals are extensively realized as habits(habits), manners(manieres), practices(usages), custom(coutume), and eventually engraved in laws. All of these function as the bonds to tie up, maintain and strengthen the relationships of men. All of these and the relationships form ‘moral networks’ like a chain. If the relative ideas and sentiments are formed in the state of their virtues, the moral networks can be justified by natural law which are approved as right reason and conscience deeply engraved in human soul. Otherwise, the moral networks, depending on the prejudices generated artificially from the civilized societies, will be a yoke to confine and violate freedom and equality of men. Rousseau advices about the latter are twofold, the best is to cultivate good morals in the hearts of the citizens as he shows in Emile, the second is to purify the corrupted morals by establishing good laws and good institutions as he designs in Social Contract.establishing good laws and good institutions as he designs in Social Contract.
