경찰 검문검색의 범죄억제 효과에 관한 연구 = A Study on the Effect of Crime Deterrence of "Stop and Search" by the Police

국문 초록 (Abstract)

  오늘날 선진 각국들이 삶의 질에 영향을 주는 높은 범죄율과 범죄에 대한 두려움을 해결하기 위해 다양한 노력을 기울이고 있다. 전통적인 경찰의 범죄통제전략이라 할 수 있는 ‘범죄와의 전쟁’과 같은 처벌 중 심적이고 강제적인 경찰활동의 방식은 그 효과성에 의문이 제기되면서 1960년대 이후 다소 밀려났으나 1980년대 이후 켈링과 윌슨의 이론에 입각하여 재강조 되고 있다.<BR>  본 연구는 이런 배경 하에 최근 한국경찰의 ‘국민생활안전확보 100일 계획’을 추진하는 과정에 인천의 한 개 경찰서를 대상으로 ‘검문검색’과 ‘범죄발생’ 간의 상관관계 등을 분석하였다. 그 결과, 검문검색을 강화한 이후 범죄발생에 있어 강도, 강간, 방화범죄는 변화가 없었으나 절도범죄는 그 이전보다 뚜렷한 감소를 나타냈다. 이런 결과를 토대로 상관관계를 분석한 결과 오토바이 검문검색과 절도발생 감소 사이에 유의적인 상관관계가 있는 것으로 나타났다. 그리고 이들 변수사이 회귀분석결과에서도 유의적 나타났다. 이러한 사실은 잠재적 범죄자로 하여금 체포되어 처벌받을 두려움을 증대시켜 범죄를 억제하고자 하는 합리적 선택이론을 어느 정도 지지하는 것으로 볼 수 있다. 따라서 기회주의 성격이 강한 절도범죄를 감소시키기 위해서는 경찰의 검문검색을 계속적으로 운용할 필요가 있다. 다만, 검문검색 방식을 택할 때 시간, 장소, 범죄유형 등을 분석하여 적절한 형태의 검문검색을 선별적으로 운영할 필요가 있다고 본다,

다국어 초록 (Multilingual Abstract)

  These days, each developed country tries to reduce the fear of crime and solve high crime rates, as they continue to effect the quality of life. Central punishment and compulsory police service activity methods, such as "a war against crime and violence", as traditional Police strategies have started to cause suspicion.<BR>  After the 1960"s, methods such as these started to deteriorate. They were then re-emphasized in the 1980"s by Kelling and Wilson"s "Broken Windows" theory. This study analyzed the relation between "stop and search" and "crime birth" as a step of the "National Life Safety"s 100 day plan".<BR>  It shows crime rate was not reduced in terms of robbery, rape, or fire. However, larceny had significantly decreased since the "stop and search" enforcement. From this, it can be said that there is an interrelation between motorcycles and larceny and the consequence of the recurrence of those variables emerging.<BR>  This fact somewhat supports the idea that increasing the fear of punishment to the potential criminal can control crime. Therefore, one can say that to decrease larceny, an opportunist needs to continue "stop and search". It needs to be merely an appropriate choice at the time, place, and crime pattern when the "stop and search" is chosen.
