중국 물류관련법제의 문제점과 해결방안 = Study on the Problems and Solutions of Logistics-Related Laws in China

다국어 초록 (Multilingual Abstract)

After China joined the World Trade Organization in December 2001, the Global Logistics Companies have taken part in China's market and are still increasingly embroiled in disputes with Chinese companies due to logistics barrier. But China's entry into the WTO and its legal reforms in accordance with global standards have a important impact on the entire system of China's logistics. Continual legal reforms enhance logistics transparency in China and stimulate the foreign investor to participate in China's logistics market.
China promulgated and implemented the related laws and regulations of the logistics industry has more than 30,000 pieces. It is undeniable that these laws and regulations to promote the field of logistics played an important positive role in China's logistics. China's logistics market is not standardized, not the legal system of the logistics market and so on.
The purpose of this paper is to enhance the understanding of China's logistics-related legal systems by finding the problems and solutions of logistics-related Laws in China.

국문 초록 (Abstract)

중국이 2001년 12월에 WTO에 가입한 후 글로벌 물류기업들은 중국시장으로 참가하기 시작하였고 물류장벽으로 인하여 중국업체들과 분쟁에 휩싸이고 있다. 그러나 중국의 WTO가입과 글로벌기준에 따른 법률개정은 중국 물류 전체 시스템에 중요한 영향을 미치고 있다. 지속적인 법률개정은 중국의 물류투명성을 제고하고 외국투자자에게 중국 물류시장으로 참가하도록 자극하고 있다.
중국은 중국물류산업의 관련 법률과 규정을 공표하고 도입하여 왔는데 30,000여개 정도를 가지고 있다. 중국의 물류관련법은 의견에서 규정, 방법, 법률에 이르는 다양한 구조를 이루고 있으며, 더욱이 중앙정부의 입법에 따라 각성과 각시는 별도의 입법을 추진하고 있어 중국의 물류관련 법률체계는 아주 복잡성을 보여주고 있다.
따라서 중국에서 물류관련 업무를 수행하기 위해서는 물류기업 특히, 외국물류기업들은 중국의 이러한 법률체계를 정확하게 이해하고, 그에 대한 법률규정을 정확하게 이해하고 있어야만 중국에서 물류서비스를 제공하는데 있어 불이익을 받지 않게 될 것이다. 이와 같이 본 논문의 목적은 중국의 물류관련 법률의 내용을 살펴보고 그 문제점과 해결방안을 도출함으로써 중국 물류관련 법률에 대한 이해를 제고하기 위함이다.
