북한이탈주민의 인도적 처리를 위한 대응방안에 관한 연구

  Nowadays, the numbers of the refugees are increasing over the world and the actual states of the affairs are growing more massive and internationalized. The problems of the refugee which are one of the tragedy of the current times and the problems are closely related with the political policy and policy on the human rights of the concerned countries. The treatments of the refugee with humanity are universal ideal of the mankind, however, the protections and aids of the refugee are decided by the concrete conditions of each country, it is seriously requested that the establishment of the solution plan in the legal basis. The protect systems of the refugee have the two concepts to protect the national interests of the concerned country and basic human rights of refugee. These two concepts are consisted of the basic principal of the system of refugee.<BR>  Accordingly, so far as existence of the country, I think that is not easy to protect the basic human rights of the refugees without any harm to protect of the nations and national interests in the category of the country. Therefore, in this aspect, I can say that it is difficult to solve the problem of refugee.<BR>  Therefore, this study examine the status of Korean refugees system and issues that had out break during the operation to the escapees from North Korea at the pre-step to treat them as refugees and syudy the policy on the treatment of the concerned countries to the escapees and draw up the plan to be adopted by the Korean Government to protect the escapees from North Korea as refugees. I propose the amendment and supplement of the Immigration Control Act which regulate the process of the recognition of Refugee based on the above study and suggest the continuous efforts for the improvement.<BR>  At the same time, should consider countermeasure for the protection of whom considered as refugee and having basic rights of refugee which comply with the UN Convention relating to the status of refugees. According to this, shall guarantee the legal status to the escapees same as foreign refugees and at the same time, it is necessary to take the policy of assimilation by the training of Korean language, job training, aids for housing, permanent residentship. For these, it is requested that the government support by the national budget. Also, bring the person up for the in charge of protection of escapees from North Korea and brothers in overseas and refugees and shall study the establish of special institute for the aids of refugees.<BR>  Come to the 21st Century, government has emphasis on the human right, therefore government shall keep the promise to the international society in sincerity. Government shall give the narrow minded ultra nationalism up and to take the policy for the systemic improvement of protect the refugees as refugee. Korean government was nominated as Nation of EXCOM of UNHCR and I hope Government fulfill the international duties which comply with the EXCOM.
