채무의 승인으로 인한 소멸시효의 중단에 관한 연구

국문 초록 (Abstract)

채무자가 일부 변제 등의 방식으로 채무를 승인한 경우에 소멸시효가 중단되고 새로운 시효가 진행된다. 채무승인은 채무의 존부 등에 관한 불확실성을 해소하는 것이다. 채무승인의 존부는 채권자의 시계에 초점을 맞추어 거래관념과 신의성실을 고려하여 합리적으로 판단된다. 상계항변의 예비성, 보충성이라는 중요한 특징에 비추어 채무의 존재를 인식하고 표명하였다고 보기 쉽지 않으므로 상계항변에 시효중단효를 인정하기 어려울 것이다.
시효중단효의 발생시기와 관련하여 원칙적으로 채무의 승인의 통지가 도달하는 시점에 시효중단효가 발생한다고 해석할 것이다. 계좌이체의 경우에 수취인은 인터넷뱅킹 등을 통하여 이체내역을 언제든지 조회할 수 있는 것이므로 초일불산입의 원칙에 따라 다음날부터 시효중단효가 발생한다고 해석할 것이다.

The effect of acknowledgement comes to pass at the time of notice. in case of account transfer The effect of acknowledgement comes to pass at the next day of transfer.
