      According to the article 114 of the National Pension Act, when the NPS has already paid the Disability Pension or Survivor Pension, the reason for payment of which was caused by the action of a third person, the position of the beneficiary with respect to his/her claim for damages shall be subrogated against the third person within the limit of the benefits payment already paid to him/her.
      However, despite such provision, the specific items in order to implement it were not consolidated and, as a result, numerous problems are occurring in practice.
      Through cross-analyzing rights of subrogation provisions in domestic social security system, and examining how other countries have stipulated the right of subrogation referring to various social security systems, the appropriate direction for Korea's national pension right of subrogation provision was determined as follows.
      First of all, in the aspect of appropriateness in benefits, specific discussion to attain reasonability on reduction adjustment of total compensation is needed, but it is worth noting, when reflecting on policy, that nations under comparison show a completely different status. The Swiss method of cutting down form the social security administration and operations redemption fund rather than implementing reduction on the beneficiaries seems the most appropriate.
      Secondly, as for the scope of a third party, and taking into account the financial status for the wrongdoer, for those cases in which the wrongdoer is forming an economic community or a labor community with the beneficiary, it would be reasonable to exclude him/her from the scope of a third party. Also, based on the provisions on The Nation Minimum Livelihood Security Law and National Pension's Early Old-age Pension, it is necessary to stipulate a standard for financial status consideration in order to determine exercise of right of subrogation on the wrongdoer.
      Thirdly, in the aspect of cost effectiveness of operation, establishing a professional council within the Social Security Corporation, in order to deliberate on the exercise of rights of subrogation, thus enhancing fairness and transparency, will be appropriate.
