Defect liability for apartment buildings refers to the liability borne by the party that constructs and supplies an apartment under the Housing Act for defects in the property with respect to the occupants or management entities. Under the current legal framework, defect repair liability under the Multi-Family Housing Management Act and defect security liability under the Act on Ownership and Management of Aggregate Buildings (hereinafter the “Aggregate Buildings Act”) coexist with respect to defects in multi-family housing. Judicial precedents likewise treat these two forms of liability as distinct and independent. Consequently, disputes concerning apartment defects have historically centered on claims for monetary damages under the Aggregate Buildings Act rather than claims seeking actual defect repairs under the Multi-Family Housing Management Act.
However, unlike general aggregate buildings, multi-family housing is governed under a public law management regime centered on the state’s housing supply system, the council of occupants’ representatives, and the housing management office. The Multi-Family Housing Management Act reflects these unique characteristics and establishes a regulatory order aimed at maintaining community life and stably securing residential functions. Therefore, defect liability must function as an integral part of such a public law management scheme.
Accordingly, defect liability under the Multi-Family Housing Management Act should primarily emphasize the actual remediation. The Act reflects this focus by imposing repair obligations on project developers and providing for defect repair orders, administrative sanctions, and security deposits Therefore, compensation for damages should be recognized only complementarily in exceptional circumstances where defect repair is fundamentally impossible.
In the early stages, the defect liability system under the former Housing Construction Promotion Act suffered from overly short exclusionary periods, and the defect repair mechanisms were not sufficiently developed. Therefore, judicial precedents started broadly recognizing civil defect security liabilities and claims for damages to protect occupants, which prompted apartment defect litigation to entrench in a damage-centered paradigm. However, this resulted in prioritizing monetary compensation over the actual remediation, thereby undermining the public law management order and the defect repair system mediated by the Multi-Family Housing Management Act.
In conclusion, defect liability for multi-family housing—supplied in large quantities under the Housing Act—should be reinterpreted as a special public law liability for the safe management of collective housing, extending beyond mere civil liability for nonperformance of contract obligations. Thus, apartment defect disputes should be resolved not through one-time monetary compensation but by fully restoring the functionality and safety of multi-family housing. Furthermore, relevant statutes and legislative refinements should be interpreted such that the Aggregate Buildings Act applies complementarily only to aggregate building sectors that are not regulated by the Multi-Family Housing Management Act, such as officetels (commercial-residential buildings) and commercial buildings.
