최근 반덤핑조치 사례의 쟁점과 시사점 = Analysis on Key Issues of Recent Antidumping Investigations in Korea - Especially, focusing on the investigation into PET film from China and India

국문 초록 (Abstract)

2007.9.5 PET필름을 생산하는 국내산업은 무역위원회에 중국 및 인도산 PET필름의 덤핑수입으로 인하여 국내산업이 실질적 피해를 입고 있으므로 덤핑수입물품에 대하여 반덤핑관세를 부과해달라는 취지의 반덤핑조사 신청을 하였다. 이에 따라 무역위원회는 약 11개월간의 조사과정을 통하여 2008.8.27 중국 및 인도산 PET필름의 덤핑수입으로 인한 산업피해 유무에 대하여 최종 긍정판정을 하고 덤핑방지 관세부과를 기획재정부장관에게 건의하였고, 기획재정부에서는 무역위원회의 건의를 받아들여 중국 및 인도산 덤핑수입물품에 대하여 5.67%~25.32%의 덤핑방지 관세를 2008년 10월 27일부터 2011년 10월 26일까지 3년 동안 부과하기로 공고하였다.
본 논문에서는 중국 빛 인도산 PET필름에 대한 반덤핑조치 사례를 중심으로 최근의 반덤핑조치 사례를 분석하고 시사점을 제시해 봄으로써 향후 반덤핑조사 사건에 있어서 무역위원회 조사 절차 및 판정 내용의 WTO 반덤핑협정에 대한 합치성을 제고할 수 있는 데 조그마한 기여를 하고자 한다.
이를 위해서 본 논문 Ⅰ.에서는 중국 및 인도산 PET필름의 조사신청 개요 및 조사경과와 조치내용을 소개한 다음에, Ⅱ.에서는 반덤핑제도에 대한 일반적인 설명을 하고, 본 사건에서 국내생산자들과 외국 수출자들 간에 치열하게 다투었던 WTO 반덤핑협정상의 주요 쟁점들을 분석하기 위해서, Ⅲ. 덤핑률 산정 관련 쟁점, Ⅳ. 국내산업 범위 관련 쟁점, Ⅴ. 반덤핑 관세부과대상 제외 요청 관련 쟁점, Ⅵ. 미소수입물량과 누적적 평가 관련 쟁점, Ⅶ. 산업피해 및 인과관계 쟁점 등으로 나누어 각각 분석하고 시사점을 제시한 후에 끝으로 본 논문의 총체적인 결론을 도출하고자 한다.

다국어 초록 (Multilingual Abstract)

As of September 5, an application for anti-dumping investigation into PET film from China and India was filed by Korean domestic producers arguing that the dumped imports threaten material injury to the domestic industry of the like product. After Korean Trade Commission(hereafter "KTC") conducted antidumping investigation for one year and made a final determination, and Ministry of Strategy and Finance is determined to impose antidumping duty on the import product from China and India from October 27, 2008 to October 26, 2011.
First of all, the purpose of this paper is to analyze the recent antidumping investigations of KTC, focusing on PET film case and organize the key issues which were engaged in a keen debate between domestic producer and foreign exporter in the course of the investigation.
Secondly, we carried out legal and economic analysis regarding the argument between the interested parties suggested in the preliminary investigation, the final investigation and the public hearing.
Through analysis and study, we hope that we make a contribution not only to enhancing legality to WTO antidumping agreement and heighten the quality of the antidumping investigation and judgement.
For this purpose, in this paper, we divided the key issues into seven categories and analyzed on the conflicting arguments of the interested parties involved that were raised in the process of the investigation ; Ⅰ. a summary of the application for antidumping investigation and antidumping measures, Ⅱ.General introduction to antidumping system, Ⅲ. Key issues on dumping calculation, Ⅳ. Key issues on scope of domestic industry, Ⅴ. Key issues relating to the request of the exception on the product under investigation, Ⅵ. Key issues relating to negligible import and cumulative assesment, Ⅶ. Key issues relating to injury to the domestic industry and causation, and all things considered, we finally reached conclusion on those issues.
