    2026년은 우리나라에 정보공개법이 입법된 30년이 되는 해이다. 이제 정보공개법은 상당수의 국민들이 인지하고 현실에서도 적극적으로 활용하는 제도로 정착되었다고 할 수 있을 것이다. 우리정부도 열린정부 홈페이지( https://www.open.go.kr)를 통한 전자적 정보공계체계를 구축하고 국민의 적극적 정보공개도의 활용을 권장하고 있는 상황이라고 할 수 있다.
    미국은 정보공개법(FOIA)이 입법된 거의 60년이라는 세월이 지났음에도 불구하고 연방법원에서 그 적용범위와 관련하여 분쟁들이 다루어지고 있다. 그것은 정보공개법(FOIA)이 행정의 투명성을 제고하기 위하여 정보공개를 원칙으로 하고 있지만 행정의 효율성이라는 가치 또한 고려할 수 밖에 없는 중요한 가치이기에 구체적 사례에서 가치판단의 요소가 배제될 수 없기 때문이라고 할 수 있을 것이다.
    이러한 행정의 투명성 제고와 행정의 효율성 확보라는 정보공개법의 근본가치가 극명하게 대립하는 부분이 우리나라 정보공개법의 비공개사유인 의사형성과정정보와 미국 정보공개법(FOIA)의 행정기관 상호 혹은 행정기관 내부의 각서 및 서신 (inter-agency or intra-agency memoranda or letters that are protected by legal privilege)이라고 할 수 있을 것이다.
    대법원은 의사형성과정정보와 관련해서는 공개의 가능성을 해당공무원들의 솔직하고 자유로운 의사소통을 어렵게 하여 적정한 행정이 어렵게 하는 효과가 있을 것을 우려해서 비공개사유의 하나라고 본 판결을 하였고 미국 연방대법원은 숙의과정특권(the Deliberative Process Privilege)을 적용하여 해당 정보가 최종 의사결정을 하기 전, 즉 의사결정전(pre-decisional)에 논의되었던 것인가와 숙의적인가(deliberative)를 분석하여야한다는 법리를 적용하고 있다. 투명한 국정운영을 위해서는 정보공개가 필요하나 과도한 정보공개는 오히려 폐해를 가져올 수 있다는 우려를 반영하고 있는 법리라고 할 것이다.
    대법원과 미국 연방대법원은 거의 유사한 법리로 아직 최종적인 결정에 이루지 않은 상태에서 적정한 논의를 위하여 제공된 회의자료, 회의록, 내부검토 자료 등에 대해서 행정의 효율성을 유지한다는 차원에서 비공개대상정보라고 판단하고 있다고 할 것이다.

By now, the Act has firmly established itself as a system that a significant number of citizens are aware of and actively utilize in their daily lives. The Korena government has also built an electronic information disclosure system via the “Open Government” website (https://www.open.go.kr) and is actively encouraging the public to make use of these information disclosure services.
    Even though nearly sixty years have passed since the enactment of the Freedom of Information Act (FOIA) in the United States, disputes regarding its scope of application continue to be litigated in federal courts. This is likely because, while the FOIA establishes a general principle of disclosure to enhance administrative transparency, it must also take into account the value of administrative efficiency; consequently, elements of value judgment inevitably come into play in specific cases. A point where the fundamental values ​​of Korean Freedom of Information Act—namely, enhancing administrative transparency and ensuring administrative efficiency—come into stark conflict can be found in the grounds for non-disclosure: specifically, information regarding the decision-making process under Korea’s Information Disclosure Act, versus “inter-agency or intra-agency memoranda or letters that are protected by legal privilege” under the U.S. Freedom of Information Act (FOIA).
    The Supreme Court of South Korea has ruled that information regarding the decision-making process may be withheld from public disclosure, citing concerns that such disclosure could hinder the candid and free exchange of views among officials, thereby impeding proper administration; similarly, the U.S. Supreme Court applies the “deliberative process privilege,” a legal doctrine requiring an analysis f whether the information in question was discussed prior to a final decision—that is, whether it was “pre-decisional”—and whether it was “deliberative” in nature. These legal principles reflect the view that, while information disclosure is essential for transparent governance, excessive disclosure can lead to adverse consequences.
