    모든 인간은 건강하게 성장할 권리를 갖는다. 아동학대의 예방은 그 기본적 조건이라 할 수 있고, 사회보장・교육 등의 분야에서 아동을 직업적으로 대면하는 인력을 통제하는 제도가 갖는 중요성이 크다. 관련 법률에서 해당 인력에게 일정한 자격・경력 등을 요구하는 적극적(positive) 자격요건을 두기도 하지만, 특정한 이력이 있는 자가 해당 분야나 직무에 종사하지 못하도록 하는 소극적(negative) 자격요건을 규정하고 그 준수 여부를 심사・감독하는 결격사유(disqualification) 제도 또한 널리 활용되고 있다.
    한국에는 국가공무원법, 교육공무원법, 사회복지사업법, 영유아보육법, 아동복지법, 학원법 등 아동 관련 종사자의 일반적 결격사유를 규정한 법제가 다수 존재하고, 개별적 취업제한명령 제도 또한 운영되고 있다. 이에 관한 논의는 제도의 부작용, 즉 결격사유 제도 등이 일률적으로 직업선택의 자유를 제한하여 헌법상 과잉금지원칙에 위배될 수 있다는 점에 집중되어 왔다. 결격사유 제도가 온전히 정당화되려면 범죄별 재범 위험성과 같은 결격사유 설정 근거에 관한 실증적 연구가 충분히 축적되어야 하고, 나아가 지금까지 논의된 바가 거의 없는 제도의 관리・감독・평가 체계까지 제대로 정비되어야 한다.

    Every human being has the right to healthy development. The prevention of child abuse may be regarded as a fundamental prerequisite for that right, and systems that regulate personnel who professionally interact with children in fields such as social welfare and education are of paramount importance. While relevant legislation may establish positive qualification requirements — such as specific credentials or work experience — for such personnel, disqualification systems that impose negative qualification requirements, prohibiting individuals with particular histories from engaging in relevant fields or positions and screening and monitoring their compliance, are also widely employed.
    In South Korea, numerous legal frameworks stipulate general disqualification grounds for child-related workers, including the State Public Officials Act, the Educational Officials Act, the Social Welfare Services Act, the Child Care Act, the Child Welfare Act, and an individualized employment restriction order system is also in operation. Discussion of these mechanisms has primarily focused on their adverse effects — namely, the concern that disqualification systems uniformly restrict freedom of occupational choice in a manner that may violate the constitutional principle of proportionality. For disqualification systems to be fully justified, sufficient empirical research must be accumulated on the grounds for setting individual disqualification criteria, such as the risk of recidivism by offense type, and, furthermore, the management, monitoring, and evaluation frameworks for these systems — subjects that have received almost no attention to date — must be properly overhauled.
    There is a need to explore reform measures that enable disqualification systems to contribute substantially to the objective of child protection without infringing upon the fundamental rights of workers. In this regard, the Blue Card system of the state of Queensland, Australia — regarded as a pioneering model — prescribes disqualification grounds in a straightforward manner, centered on the Working with Children Check Act 2000, while ensuring that supplementary measures such as risk assessments conducted by specialist personnel, and judicial review by bodies such as the Queensland Civil and Administrative Tribunal (QCAT), serve as complementary safeguards. This system offers significant implications for South Korea in respect of its intuitive design, its structure that holds workers, employers, and supervisory authorities individually accountable for the practical implementation of the scheme, its continuous efforts to evaluate and revise the system, and its use of electronic technology to enable real-time monitoring and to enhance accessibility. This article concludes by recommending sustained research and legislation directed at systematizing disqualification frameworks, empirically justifying individual disqualification grounds, and establishing mechanisms for the continuous evaluation and improvement of the system.
