법교육지원법에 관한 비교법적 고찰

국문 초록 (Abstract)

우리나라의 법교육은 1980년대부터 법교육 관련 연구를 통해 시작되었고, 2005년 법무부의 법교육연구위원회 출범과 2008년 법교육지원법이 제정되면서 본격화 되었다. 이와 같이 우리나라 법교육 발전에 상당한 영향을 주고 있는 것이 미국의 법교육이며, 1978년 제정된 법교육지원법(Law-Related Education Act of 1978)이다. 그런데 우리가 모델로 삼고 있는 미국의 법교육지원법은 여러 연구에서 언급되고는 있으나, 그 실체와 본질을 파악하기 위한 심도 있는 연구가 부족하였고, 살아 숨쉬고 있는 법률의 현재의 모습 등은 분석된 바가 없다. 이와 같은 측면에서 미국 법교육지원법 전반을 법제사적 연구방법을 통해 1978년 법교육지원법과 그 발전과정을 상세히 살펴보고, 2008년 제정된 우리나라 법교육지원법과 법률의 주관부처, 법제정의 목적과 필요성, 주요 내용 등을 기준으로 비교하고 시사점을 도출하여 향후 우리나라 법교육의 발전 방향을 모색해 보고자 하였다.

다국어 초록 (Multilingual Abstract)

The term “law-related education” means education to equip non-lawyers with knowledge and skills pertaining to the law, the law process and the legal system, and the fundamental principles and values on which these are based(LRE Act of 1978).
This study intend to review the law-related education Act in U.S.A. That is what the object and main contents is and how to develop and what the current is. We can get the result of LRE Act currents, it had several repealed and omitted in educational law. Now, it is difficult to find ‘LRE program’ in law database and also access the name is ‘we the people’ program this is same content to LRE program.
Our country made LRE Act in 2008. The Justice department is deal with LRE program and make policies on it, but the ministry of education and science technology don’t have positive actions. We consider this circumstance, we easily guess that it is difficult to promote and activate LRE program with only the justice department’s effort.
So, It is helpful for study law-related education act’s histories and backgrounds in U.S.A and we could more learn and know how to develop our country’s current status with law-related education.
