NPEs의 규제 강화에 대한 고찰 -『지식재산권의 부당한 행사에 대한 심사지침』개정을 중심으로 -

The regulation of severe attacks of NPEs is the international flows, and national competition authorities to form a consensus on the regulation of NPEs. Therefore to meet, the Korea Fair Trade Commission prepared the specific legal basis for sanctions of NPEs. This study is primarily to the emergence of NPEs in the process of strengthening the pro-patent policy in the United States to review the positive features and negative features of the industry. and “Examination Guidelines for wrongful exercise of intellectual property rights” recently amended Korea Fair Trade Commission to investigate and analyze whether this will affect the future. There is significant in that it embodies criteria than on the type of IPR(intellectual property right) abuse through a revision of the “Examination Guidelines for wrongful exercise of intellectual property rights”. In particular, we expect to be able to act to protect domestic firms from IPR(intellectual property right) abuse of
NPEs By providing specific regulatory standards for abuse of monopoly power over the intellectual property rights of NPEs.
