배우자 살해의 유형과 특성

국문 초록 (Abstract)

배우자 살해는 모든 범죄 가운데 가장 심각한 범죄의 하나라고 볼 수 있으며, 배우자 관계에서 일어날 수 있는 가장 극단적인 형태의 상호작용이자 치명적인 결과로 간주할 수 있다. 이 논문은 사건 기록을 분석하여 우리나라에서 일어난 배우자 살해 사건의 주요 특징과 동기, 진행경과 등을 살펴보고, 특히 사건의 진행과정을 사건 발생 이전에 당사자 사이에 형성된 상호작용의 성격과 관련지어 논의하고 있다. 분석결과 남편에 의한 아내살해와 아내에 의한 남편살해는 사건의 동기나 진행과정에서 다소 분명한 차이가 있는 것으로 드러났다. 배우자 살해 사건에서 가정폭력이 문제가 되는 사건이 드물지 않았는데, 이 때 가정폭력의 가해자는 남편에 의한 아내살해와 아내에 의한 남편살해 모두에 있어 남편인 경우가 보다 일반적이었다. 배우자 관계가 한쪽에 의한 다른쪽의 살해라고 하는 극단적 상호작용에 이르게 하는 또 다른 주요 요인으로는 사랑과 증오에 관련된 문제를 들 수 있다. 남편에 의한 아내살해에 있어서는 아내의 외도나 결별요구와 관련된 사건이 적지 않았고, 아내에 의한 남편살해에서는 남편의 의심이나 집착이 문제가 되는 사례들이 다수 있었다. 그러나 배우자 관계가 그 특성상 장기간 지속되면서 형성되고 변화해온 다면적이고 복합적인 측면을 가지고 있기 때문에 배우자 살해는 단순하게 이해하기 어려운 다양한 동기를 가지고 있을 뿐만 아니라 사건의 진행과정 역시 배우자 사이의 상호작용이 가진 복잡한 특성을 반영하는 것으로 나타났다.

다국어 초록 (Multilingual Abstract)

Marital homicide can be regarded as one of the most condemned crime and the most tragic outcome of spousal relationship. The study examines the general characteristics and mojor motives of murders in spousal relationship. It reviews the proceedings of acts and events in the criminal scenes with reference to the previous interactional characteristics of the fatal couples. It analyses 56 cases of criminal homicide in intimate relationship indicted for three years from 1995 to 1997 in Seoul. These 56 cases have 68 offenders and 61 victims.
It is found that the histories of family violence and situations involving in the love triangle art two most important factors leading to fatal attacks in spousal relations. About half ot the cases have histories of violence by offender or victim. There are significant gender differences in motives and proceedings of homicides among married couples. More than 40% of males who kill their female partners are perpetrators of family violence, but most of females who kill their male partners do so after suffering repeated violent attacks.
People might kill their mates because they find themselves involved in love triangles. Females art likely to have higher risks of lethal attacks by their husbans when they are engaged in love affairs with men ohter than thei own husbans and when they art suggesting divorces or making estranging gestures to their mates. Males are likely to have higher risks of fatal attacks by their own wives or allies of their wives when they distrust and cling to their estranged partners.
While histories of violence and affairs of love triangle are most important factors leading to fatal outcome in spousal relations, it is not easy to classify marital homicides into several distinct types. Marital relationships generally have long histories and multi-faced aspects of interaction which affect the motives and proceedings of fatal attack. The study proposes that marital homicide should be viewed as a outcome of dynamic exchanges of struggle tactics between husband and wife not only in the narrow context of criminal scene but also in the wider context of violenct and non-violent interactions.
