The real estate auction system in Korea functions as a formal legal mechanism for satisfying creditors’ claims; however, it frequently undermines the rights of tenants residing in auctioned properties. This study investigates how inconsistencies and interpretive conflicts among the Housing Lease Protection Act, the Civil Execution Act, and the Real Estate Registration Act hinder the effective protection of tenant rights throughout the auction process. By categorizing recurrent infringement patterns—such as priority disputes with provisional registrations, failures in mandatory notification, and structural deficiencies in public information disclosure—the research conducts a legal doctrinal analysis supported by key judicial precedents.
Based on this analysis, the study proposes six structural reform strategies: (1) introducing a pre-registration system for lease rights to ensure enforceable publicity, (2) integrating administrative and registry databases for accurate disclosure in auction records, (3) enabling time-stamped resident registration to resolve conflicts arising on identical dates, (4) establishing mandatory identification of actual occupants in corporate lease contracts, (5) adopting automated dividend-notification systems for vulnerable tenants, and (6) constructing a unified digital platform for tenant-related rights information.
The findings demonstrate that the current legal framework provides only formalistic protections, while systemic information gaps and procedural barriers lead to substantial, recurring infringements of tenant rights. This research offers a practical and institutionally grounded reform roadmap, contributing to a shift from nominal statutory safeguards toward an effectiveness-oriented paradigm of tenant protection in Korea’s real estate auction proceedings.
