This study analyzes cases of house fraud involving the misuse of names of individuals with intellectual disabilities, aiming to identify structural changes in house fraud and propose responsive policy measures. Traditional house fraud has typically involved schemes led by sales agencies, collusion with licensed real estate agents, information asymmetry, and abuse of guarantee insurance systems— primarily driven by market opacity and institutional disconnection. However, the recent misuse of intellectually disabled individuals’ names reflects a new typology that combines structural weaknesses in social welfare, gaps in guardianship systems, and the lack of interagency information sharing. The analysis reveals that persons with disabilities were repeatedly instructed by criminal organizations to sign contracts, transfer residency, and register ownership without understanding the binding nature of such agreements. As a result, they suffered triple-layered victimization—treated simultaneously as landlords, debtors, and criminal suspects.
This outcome stems from the limitations of the Special Act on house Fraud, which defines victims narrowly as tenants, and the Housing Lease Protection Act, which does not extend protection to vulnerable name-holders. Furthermore, the absence of data linkage among welfare agencies, local governments, and guarantee institutions prevented early detection of suspicious transactions. In response, this study proposes the introduction of pre-contract risk filters, more rigorous guarantee insurance screening, expansion of explanatory obligations for real estate agents, establishment of an integrated supervisory framework connecting welfare, housing, and guarantee institutions, and inclusion of vulnerable name-holders under legal protection. By redefining house fraud as a complex crime situated at the intersection of institutional, social, and market dynamics, this study emphasizes the need for a protection-oriented policy response for socially vulnerable populations.
