회복적 사법과 노인 대상 범죄의 대책 = Restorative Justice and Measures of Crimes Targeting the Elderly

다국어 초록 (Multilingual Abstract)

Every people has the rights as a human being to ensure minimum rights and to pursue happiness within the social order. These rights are basic rights guaranteed by the constitutional law, and an area that no one can violate. Nevertheless, elderly people who should be respected are not easy to respond actively to social changes, so they are tend to be targeted by various crimes. In particular, their basic rights are easily violated by abuse.
In the past, the elderly were respected and the subject of teaching. In addition, they were heads who judged right and wrong about everything that happened in the family. Although the status and role of the elderly have been reduced due to various social changes, it should not be forgotten that Korea has been able to be developed by their efforts as a sovereign nation.
If becoming victims of crimes, the elderly have difficulties to restore theirs only with traditional criminal justice system because they are not easy to respond actively to social change. Thus, it is necessary to take restorative justice as a complement to traditional criminal sanctions. Restorative justice is not totally different system with traditional criminal justice. Restorative justice is also implemented in accordance with the same principles contained in traditional criminal justice, if it disadvantages the people regardless any form of operation. In addition, restorative justice should be operated in a way that enhances the efficiency of the system by correcting and compensating the shortcomings of the traditional criminal justice system. In other words, if the two systems expand and enhance the benefits of each other along with cooperation between government and local communities, we will be able to find more efficient ways to deal with crime.
