방송과 저작권법 = Broadcasting and copyright Act

국문 초록 (Abstract)

방송프로그램에 있어서 표절이나 모방은 저작권 침해에 해당한다. 작품구상이나 아이디어 차원 정도의 인용이나 모방은 창작품으로 인정할 수 있지만, 포맷 모방은 창작품으로 보기 어렵다. 특히, 오락프로그램이나 와이드쇼의 경우, 포맷 모방은 표절에 가깝다. 따라서, 모방이나 표절에 대한 판단은, 프로그램의 내용에나 흐름, 무대장치 등 모방지수를 개발하여 누계 적인 지수를 토대로 종합적인 판정을 내려야 한다.

다국어 초록 (Multilingual Abstract)

Recently, Plagiarism and copyright have become a social issue. We should legally copy for if not are certain to infringe a copyright and violate an intellectual property right.
The problems of plagiarism and copy violation deals with a writer and a producer's morals or ethics issue more than just copyright laws.
The problem has come to such a serious social issue, therefore, we must act quickly to establish the legal and institutional devices to check on this otherwise, we would be caught up with international lawsuits and that would leave us with a bad name of "a Heaven for Plagiarism".
Nowaday, with the development of the digital technology, the changing and copying in the field of media are done with relative ease. It often raise a case of the infringement of copyright so, copyright laws on broadcasting programs for this digital age must be established quickly. Therefore, I suggest the following points when implementing copyright laws on broadcasting programs
1. Legal countermeasure
(1) Though it is still consider legal to borrow plots and ideas from other broadcasting programs but the imitation of its format should be discouraged and therefore, copyright and plagiarism. laws should be put in place to prevent such infringement.
(2) Copyright Laws should also prevent the imitation of the program contents and settings.
For series programs, copyright laws should evaluate if the televising program has infringed the copyright act based on the number of infringements for the whole series.
