프랑스 교정행정의 개혁과 과제 = Correctional treatment reform and tasks in France

다국어 초록 (Multilingual Abstract)

France has been priority sentence to offenders parole restriction policies torepeat offender for the past 20 years. As a result, prisoners have no hope of paroleand rehabilitation. There are so many problems like overcrowding, violent inmates,escape and assault prison officers. The suicide rates of inmates is most highest inEurope Country. Also the strike of prison guards is continued on every year causedby indignity and inhumane prison conditions.
And they did not supply to muslim halal meal in accordance with the secularism.
The Muslim prisoners and Islamic community in france have been opposed to thatpolicy.
By the way, France promoting prison reform policy - tour of France- from 2012.
But France government have to overcome some issues.
First, Frans society must have social consensus about whether to guarantee thelabor rights of prisoners. Second, Frans government should be solve most highsuicide of prisoners and dehumanized material conditions. Third, it should reclaimthe preferred sentence and solitary imprisonment. Fourth, there is a room forimprove secularism in halal meals for prisoners. Fifth, France government shouldexpand the community correction.

국문 초록 (Abstract)

프랑스는 지난 20여년 간 범죄자에 대한 구금형 우선주의와 상습범 등에 대한가석방제한정책 등으로 수형인구의 과밀화현상을 초래하였고, 가석방 없는 수형자들이 사회복귀의 희망을 잃으면서 수형자간 폭행이나 교도관 폭행, 탈출, 자살 등의일탈이 심각해졌다. 이에 따라 프랑스 교도소는 유럽에서 가장 높은 수형자 자살율을 보이고 있고, 열악한 교정환경에 반발하는 교도관의 파업도 연례행사처럼 발생하고 있다. 또한 정교분리주의에 따른 할랄급식이 이루어지지 않아 무슬림 수형자들의 불만 뿐만아니라 전체 프랑스 이슬람공동체의 비난을 받고 있다.
프랑스 정부는 이와 같은 문제점을 극복하기 위하여 2012년부터 프랑스의 여행이라는 정책명에 따라 교도소개혁을 추진하고 있지만 몇 가지 당면과제를 해결해야할 것으로 보인다. 첫째, 수형자의 노동권을 어느 정도 보장할 것인지에 대한 사회적 합의가 있어야 할 것이다. 둘째, 수형자의 자살문제를 해결할 방안을 마련해야한다. 셋째, 구금형 우선주의라는 프랑스 형사정책의 근본적인 변화를 도모하여야한다는 것이다. 넷째, 정교분리주의와 할랄급식문제에 대한 사회적 관용이 필요하다.
프랑스 교정당국이 처한 개혁과제들은 한국의 교정정책에도 시사하는 바가 크다.
예를 들어 수형노동에 대한 적정한 급여수준, 노동조합결성권, 단체행동권 등을 부여할 것인지, 투표권을 인정할 것인지 등은 인권적 차원에서 법적 다툼의 소지가있다. 또한 교정시설 내에서 일과 중 낮 기도를 허용해야하는 지도 다른 종교와의형평성 원칙상 적당한지 검토되어야 한다.
