국가와 지방자치단체 간 복지재정의 비용부담에 관한 해법의 모색 = For the distribution system of the cost burden on the social welfare between the state and local governments

국문 초록 (Abstract)

본 논문은 국가와 지방자치단체 간의 사회복지재정의 비용분담체계를 중심으로 재원배분의 체계 및 사무분배의 체계와 관련하여 제기되는 문제를 논하고 그에 대한 총체적인 해법을 모색해 보고자 하였다.
사회보장기본법에 따르면 사회보장 비용의 부담은 각각의 사회보장제도의 목적에 따라 국가, 지방자치단체 및 민간부문 간에 합리적으로 조정하도록 하면서, 특히 사회서비스와 관련하여 일정 소득 수준 이하의 국민에 대한 사회서비스에 드는 비용의 전부 또는 일부는 국가와 지방자치단체가 부담하며 부담 능력이 있는 국민에 대한 사회서비스에 드는 비용은 그 수익자가 부담함을 원칙으로 하되, 관계 법령에서 정하는 바에 따라 국가와 지방자치단체가 그 비용의 일부를 부담할 수 있도록 규정하고 있다. 이와 관련하여 최근 무상보육이나 무상급식, 기초연금 등에 대한 비용부담 논란이 제기되고 있다.
비용부담에 관한 논란은 무엇보다도 국가와 지방간의 사무배분과 재원배분, 비용부담 간의 괴리에 기인한 것이다. 특히 사무배분과 재원배분에 있어서 중앙집권적인 구조와 국가와 지방자치단체 상호간의 비용부담의 전가 등이 그 원인이다. 이에 대한 해법으로는 중앙집권적인 사무배분을 개혁하고 재정조정제도 등 재원배분 구조를 개혁하며 견련성의 원칙에 따라 원인을 제공한 측에서 비용을 부담하도록 하는 것이 필요하다. 그러나 이것만으로는 부족하고 새로운 사회에 대한 희망과 복지 철학, 방향설정이 필요, 복지예산의 확대와 점진적 증세의 필요성, 지방세 비중 확대, 지방교부세 및 지방교육재정교부금 확대, 보조금제도의 문제점 해결 등과 함께 지방분권적 헌법개정 노력 등 총체적인 해법이 필요하다.

The article deals with the problems related to the distribution system of the cost burden on the social welfare between state and local public finances in order to find a holistic solution for them.
The Social Security Act requires that the burden of social security costs between the state and local governments and the private sector in line with the objectives of any system of social security should be adjusted appropriately. In particular, all or part of the cost of social services for people below a certain income level in the field of social
services should be borne by the state and local governments, the cost of social services for people with ability to pay should those beneficiaries bear but in principle, as prescribed in the relevant laws and regulations state and local governments may also bear some of the costs. In this regard, recently the debate about the costs such as free
child care and free meals, expenses for basic pension has been raised.
The cause of all this controversy is the discrepancy of the division of tasks, financial distribution and costs between the state and local governments. Especially, the centralized structure of the state and the shifting of costs between the State and local governments are the cause.
A solution for this is the reform of financial equalization. However, the financial compensation has a limit itself, the system error can not overcome. The solution does not only refer to concomitant financing, but also close to the distribution of tasks and output distribution. Therefore it is necessary to change the constitution in the direction
of decentralization. And moreover, the reform to the structural problems of the state should come in connection with the direction of a new society and the need for a gradual expansion of the welfare budget.
