뉴질랜드 정부의 정신장애인 인권보호 정책에 관한 연구 = The Assurance on Human Rights of the Mentally Ill of New Zealand -Focused on Involuntary Admission and Social Discrimination-

국문 초록 (Abstract)

정신장애인 인권보장의 핵심적 과제는 강제입원과정에서의 자기결정권 보호와 사회적 차별로부터의 보호이다. 이 연구는 뉴질랜드 정신보건체계 속에서 두 가지 핵심적 권리가 어떻게 보호되는지 알아보고 정신보건법 이후에도 정신장애인의 권리가 제대로 보장되지 못하는 우리나라 정신보건체계에 권리보호를 위한 대안을 제시하였다. 뉴질랜드 장신보건법에 의하면 정신장애인을 강제치료하기 위해서는 두 번의 평가 및 치료단계와 심의단계를 거쳐야 한다. 강제치료가 불가피하다고 판단되면 우선적으로 지역사회치료명령을 내리고 강제상태에서도 정보를 제공받고 문화를 존중받을 권리가 법적으로 보호된다. 또한 사회적 차별에 대해 인권법에 근거하여 정신장애인에 대한 차별을 불법으로 간주하고 있으며 정신장애인에 대한 대중의 편견을 변화시키기 위해 ``Like Minds, Like Mine``이라는 특징적 프로그램을 수행하고 있다 이러한 연구결과를 바탕으로 연구자는 우리나라 정신보건법 하에 강제입원과정 모형을 제시하고 지역사회치료명령제도 도입을 제안하였다. 또한 정부주도 하의 적극적인 차별극복 노력을 제안하였다.

다국어 초록 (Multilingual Abstract)

The core problems of the assurance on human rights of the mentally ill are the violation of self-determination and the social discrimination. This study aims to find out the policies to counter social discrimination and to assure self-determination associated with compulsory treatment process of New Zealand government. A compulsory treatment order in New Zealand is a court order made by a judge through several assessments and hearings based on Mental Health Act. The Act says the patients should be placed on a community treatment order unless there are good reasons for patients not being treated in the community. Even if the patients are placed under a compulsory treatment order, all service consumer`s rights still apply to patients. New Zealand government consider the discrimination against the mentally ill as unlawful. So Ministry of Health supports Like Minds, Like Mine that aims to change the public prejudice and stigma against the mentally ill through Mass Media. According the policies of assurance on human rights of New Zealand, this study suggested that government initiated anti-stigma campaign and fair judgement of compulsory treatment for the promotion of human rights of the mentally ill are needed in Korean mental health system.
