성매매 알선범죄에 대한 대책으로서 행정처분 및 몰수 ･추징의 활용방안 = Effective Countermeasure Against Prostitution Arrangement Crime Focused on administrative measure & confiscation/imposition

Since there is a social consensus on the seriousness of the issue of illegalprofit generated through prostitution, eradiation of the prostitution arrangementact and complete deprivation of illegal profit have become a social issue thatcould no longer to delayed. Upon recognizing such issue, the government hasbeen presenting various preventive and response measures since theenactment of prostitution punishment law a decade ago. However, it isnecessary to point out the issues with current system to establish moreeffective policies. In particular, the act of arranging prostitution by leasing abuilding while being aware of prostitution that is taking place allowsprostitution to continuously occur and spread by securing safe location of prostitution.
Accordingly, its illegality cannot be regarded as insignificant and there is apossibility that the crime cannot be sufficiently prevented with imposition ofprincipal penalties or arbitrary confiscation/imposition alone in the sense thatmain motive of crime is financial gain. Accordingly, there is no choice but tohold doer responsible to allow actual crime prevention power for thepunishment of prostitution arrangement to cut off the connecting link ofprostitution from being re-produced at industry level, as well as prevent theenticement of illegal profit by arranging prostitution.
In addition, the shortcut to eradicating the acts of arranging prostitutionwould be to enforce strong administrative restriction through variousadministrative regulations such as regulation of amusement business affectingpublic morals, as well as actively apply criminal punishment provisionsaccording to prostitution punishment law. Based on such basic critical mind,this paper examined the present condition of current administrative measuresystem and confiscation/imposition system to eradicate acts of arrangingprostitution and presented methods of improvement by pointing out relatedissues.

국문 초록 (Abstract)

성매매로 인하여 창출되는 불법적인 수익으로 인한 문제가 심각하다는 점에 대하여사회적 인식의 공감대가 형성되어 있으므로, 성매매알선행위의 근절과 불법수익의완전한 박탈은 이제 더 이상 늦출 수 없는 시대적인 과제가 되었다고 판단된다. 물론성매매처벌법을 시행한지 10년이 지난 현재의 시점까지 정부에서도 이러한 문제의식에입각하여 여러 가지 예방 및 대처방안을 제시하고 있기는 하지만, 보다 효과적인 정책수립을 위해서는 현재의 제도에 대한 문제점을 지적하지 않을 수가 없다. 특히 성매매에제공되는 사실을 알면서 건물을 임대하여 영업으로 성매매알선행위를 하는 것은, 안정적인 성매매 장소를 확보하게 하여 성매매가 지속적으로 이루어지게 하고 이를 확산시키므로, 그 불법성이 결코 적다고 할 수 없으며, 이는 범죄의 가장 주된 동기가 경제적이익의 취득에 있다는 점에서, 주형의 부과나 임의적인 몰수 ･추징만으로는 범죄의예방이 충분히 달성되지 않을 수 있다. 그러므로 성매매가 산업적으로 재생산되는 연결고리를 차단하고 성매매알선 등 행위를 통해 불법수익을 얻으려는 유인을 막기 위해서는, 성매매알선 등 행위에 대한 처벌이 실질적 위하력을 가지도록 행위자에게 강한책임을 물을 수밖에 없는 것이다. 또한 성매매처벌법에 따른 형사처벌조항의 적극적인적용과 동시에 풍속영업규제법 등 각종 행정법규를 통한 강력한 행정제재를 병과하는것이 영업으로 인한 알선행위 척결의 지름길이 될 수 있을 것이다. 이와 같은 기본적인 문제의식을 바탕으로 하여 본고에서는 성매매알선행위의 근절을 위한 현행 행정처분 제도 및 몰수 ･추징제도의 현황을 파악한 후 문제점을 지적하면서 개선방안을 제시해 보았다.
