    일본국헌법 제41조는 국회를 “국가의 유일한 입법기관”으로 규정함으로써 입법권의 전속성을 명시 하고 있다. 그러나 일본의 실제 입법과정은 헌법 규범과 일정한 괴리를 드러낸다. 본 논문은 일본의 입법과정과 그 제도적 특성을 분석하고, 그 가운데서도 여당 내 정당기구를 중심으로 형성된 사전심사 제의 제도적 정착과 헌법적 함의를 규명하는 데 목적이 있다.
    첫째, 일본의 입법과정은 형식적으로는 내각 또는 의원에 의한 법률안 제출을 시작으로, 소관 상임 위원회에서의 심의를 거쳐 본회의에서의 표결을 통해 법률이 성립되는 절차를 따르고 있다. 그러나 내 각제도의 구조적 특성과 정당정치의 정착에 따라, 내각제출법안이 전체 법률안의 대다수를 차지하며, 국회의 심의기능은 본질적인 정책조정보다는 승인적 성격으로 기능하는 경우가 많다. 또한 위원회 중심주의라는 제도적 틀에도 불구하고, 여당 주도의 사전심사, 정례일 제도, 예산위원회의 우월적 지위 등은 국회 심의의 실질성을 제약하는 요인으로 작용하고 있다.
    둘째, 자민당 정무조사회와 총무회를 중심으로 작동하는 사전심사제는 헌법이나 국회법상 근거가 없는 정치 관행임에도 불구하고, 실제 입법권 행사에 있어 결정적 관문으로 기능하고 있다. 본 논문은 특히 1962년의 이른바 ‘아카기 서한’을 전후로 총무회 승인까지를 요건으로 하는 이중 심사구조가 제도화된 과정을 실증적으로 고찰하였으며, 이를 통해 일본의 입법권이 국회, 내각, 정당이라는 복수 주 체 간에 분산된 ‘이중구조화된 입법권 구조’로 정착되었음을 논증하였다. 이러한 구조는 입법권의 헌법상 귀속 주체에 관한 해석론뿐 아니라, 권력분립 및 민주적 정당성 원리에 대한 재검토를 요청하는 바, 본 연구는 일본 입법정치의 제도적 현실을 통해 의원내각제 국가에서의 정당조직과 입법권의 관계를 이론적으로 조명하고자 한다.

    The Constitution of Japan stipulates in Article 41 that the National Diet shall be “the sole law-making organ of the State,” thereby affirming the principle of exclusive legislative authority. However, the actual legislative process in Japan deviates from this constitutional ideal. This study examines the structural characteristics of Japan's legislative process and, in particular, analyzes the institutionalization and constitutional implications of the ruling Liberal Democratic Party (LDP)’s preliminary review system.
    First, although the formal legislative process involves the submission of bills by either the Cabinet or members of the Diet, followed by committee deliberation and plenary vote, the dominance of Cabinet-initiated legislation and the coalition-based structure of the Japanese parliamentary system have led to a significant reduction in the substantive deliberative role of the legislature. Institutional factors—such as the predominance of standing committee procedures, rigid calendaring rules, and the quasi-plenary function of the Budget Committee— further constrain parliamentary autonomy and reinforce executive-legislative fusion.
    Second, this paper investigates the emergence and entrenchment of the LDP's internal pre-legislative coordination mechanism, wherein the Policy Affairs Research Council and the General Council exercise de facto approval authority over Cabinet bills prior to Diet submission. In particular, the 1962 “Akagi Letter” formalized a dual-review structure requiring both councils’ consent. Based on empirical analysis of legislative records between 1956 and 1965, the study demonstrates that this informal party mechanism has evolved into a structurally embedded “double-layered legislative authority.” Such a configuration, in which legislative power is dispersed among the Cabinet, the Diet, and party institutions, challenges the normative premises of the separation of powers and calls for a reevaluation of constitutional accountability and legislative legitimacy in parliamentary systems.
