Human history has shown numerous times that even the basic rights of the people may violate the basic rights of others if exercised by groups. In such historical experience, Germany has a premise for freedom of assembly in Article 8 of the Basic Law, unlike Article 21 of the Korean Constitution. In other words, the German Basic Law requires the prohibition of carrying weapons and peace as prerequisites for assembly. In addition, it stipulates that outdoor assembly can be limited by law. Unlike Korea, Germany has declared that the Constitution only guarantees peaceful assembly, so it does not recognize violent assembly or demonstration itself. In addition, Germany has demanded a ban on weapons possession, blocking the risk of violent assembly or demonstration in advance. Furthermore, Germany imposes administrative costs in addition to penalties and fines for violations in assembly and demonstration. In this respect, Germany shows that assembly and demonstration are not protected indefinitely, even if they are important basic rights of the people.
In Germany's legal order, the maximum guarantee of freedom of assembly is possible on the premise of an assembly that excludes violence and illegality. This can be seen as quite different from us, who often clash with public power and illegalize and violence in the process of assemblies and demonstrations on important social issues. The social costs incurred by illegal and violent rallies eventually return to the burden of the entire people. The current Assembly Act also stipulates the matters to be observed for assembly organizers and participants, as shown in the German assembly law. However, the difference between the two is the regulation on the cooperative relationship between the organizer and the administrative agency. German assembly law imposes an obligation on assembly organizers to be able to contact the competent administrative agency. In addition, if a police officer enters an assembly, the assembly organizer must be notified, and in this case, the organizer must provide the police officer with an appropriate seat.
Without these regulations, we have a problem that the device to prevent violent rallies is insufficient. In addition, appropriate sanctions or penalties for possession of weapons, which are frequently seen in violent protests, are weak. Anyway, Germany's assembly law emphasizes the obligations of the organizer and participants of the assembly, the scope of the assembly prohibition area, the prohibition of possessing weapons, the prohibition of similar uniforms and the prohibition of wearing masks, and the generation of video and audio records at the assembly site. Looking at the example of Germany, we think it is time to look back on what freedom of assembly is in order to build a peaceful assembly culture from the experiences gained through numerous rallies. This paper describes the German Federal Assembly Act II. General Regulations III. Open Indoor Assembly IV. Penalties and penalties for outdoor public assembly V. Ⅵ. The purpose of this study is to learn lessons from the revision of our assembly law.
